$97 Million Judgment To Nicaraguan Plaintiffs Denied By Florida Federal Judge
MIAMI - Dole Food Co. and The Dow Chemical Co. cannot be forced under the Florida Uniform Out-of-Country Foreign Money-Judgments Recognition Act to satisfy a $97 million judgment awarded to 150 Nicaraguan citizens who allege reproductive injuries from exposure to dibromochloropropane fungicide in Nicaraguan banana fields, U.S. Judge Paul C. Huck of the Southern District of Florida said Oct. 20, because the Nicaraguan trial court lacked jurisdiction over the claims and violated the due process rights of the defendants (Miguel Angel Sanchez Osorio, et al. v. Dole Food Co., et al.,. No. 07-22693, S.D. Fla.). From Mealey's Emerging Toxic Torts
