Magistrate Says Failure To Implement Litigation Hold Was Grossly Negligent

ROCHESTER, N.Y. - A federal magistrate judge in New York on March 31 ordered a plaintiff company in a breach of contract suit to pay costs incurred for additional depositions necessitated by its delayed production of documents and its failure to implement a litigation hold, which the magistrate judge found was the result of gross negligence (Crown Castle USA Inc., et al. v.
