United States Sides With Merck Shareholders In Supreme Court
WASHINGTON, D.C. - The U.S. Office of the Solicitor General filed an amicus brief in Vioxx derivative litigation before the U.S. Supreme Court on Oct. 26, supporting Vioxx derivative plaintiffs who say that even if they were on "inquiry notice" of potential securities fraud in September 2001, they could not have established the requisite scienter until learning that Merck & Co. executives did not believe their own claims of the drug's safety (Merck & Co., Inc., et al. v. Richard Reynolds, et al., No. 08-905, U.S. Sup.).
