5th Circuit Panel Reverses Order Dismissing Tort Claims For Climate Change Damage
NEW ORLEANS - A unanimous Fifth Circuit U.S. Court of Appeals panel on Oct. 16 said residents of the Mississippi coast have standing to sue the coal, petroleum and chemical industries for property damage resulting from Hurricane Katrina because the companies' alleged contributions to climate change are compensable under theories of nuisance, negligence and trespass (Ned Comer, et al. v.
