<title>Contingent Business Interruption - The 'Silent' Coverage</title>

Weinstein Much has been written through the years on the subject of "Business Interruption" insurance, including how the coverage terms for this type of coverage have evolved over time. Far less attention has been paid to the equally important but often misunderstood coverage known as "Contingent Business Interruption" ("CBI") insurance. This inattention is reflected in the rather scant wordings that generally appear in first-party policies relating to this insurance - it almost seems sometimes that CBI coverage is included as an afterthought. Nonetheless, this structure seemed to work well for many years, but as is so often the case in insurance law, a catastrophic loss event places specific coverage terms under a microscope and creates dilemmas that can lead to litigation over the application of these wordings. Whereas 9/11 begat policy language debates relating to such terms as "occurrence" and "civil authority," the one-two punch of Hurricanes Katrina and Rita in 2005 and the consequent widespread disruption of facilities and transmission components in the oil and gas industry required insurers and their attorneys to pay close attention to CBI coverage. This increased focus has led to some interesting dilemmas over the manner in which CBI coverage comes into play when a catastrophe occurs.
