<![CDATA[DES MOINES, Iowa - Punitive damages may not be recovered from the estate of a deceased wrongdoer, the Iowa Supreme Court held Aug. 5, affirming a trial court's decision not to award such damages against the estate of a man who chopped down dozens of his neighbor's trees (In the matter of the estate of Johnny Vajgrt, Deceased; Bill Ernst, Inc., Intervenor-Appellant, No. 10-1088, Iowa Sup.; 2011 Iowa Sup. LEXIS 56).

<![CDATA[By Victor Schwartz Recently, in two asbestos-related cases in two very different jurisdictions, juries rendered huge multi-million dollar punitive damage awards. In April, a Los Angeles jury awarded $200 million in punitive damages on top of an $8.8 million compensatory damage award to a woman who alleged she contracted an asbestos-related cancer. Less than a month later, in May, a Mississippi jury awarded a $322 million punitive damage award on top of a $22 million compensatory award to a man who alleged he contracted asbestosis.
