Williamson v. Shrackle & Shrackle Construction Company Case File

Professor Fergus D. Williamson was crossing the street when he was struck by the company pickup truck of Charles T. Shrackle. Williamson has filed a civil negligence suit with the Nita State courts, claiming that Shrackle's negligence caused him severe injury and disability. Shrackle admits to hitting Williamson, but claims that he was crossing in the middle of the street, not the crosswalk, and that Williamson did not look before entering the road. The defendant denies negligence, instead alleging contributing negligence on the part of the plaintiff. There are three witnesses for the plaintiff and four for the defendant.

Steven Friedman
- Steven A. Friedman is a trial lawyer with extensive experience in a wide variety of commercial litigation areas including antitrust, contract, banking and trade secret matters. In addition to his commercial litigation practice, Mr. Friedman has particular expertise in representing owners in all aspects of construction projects including dispute resolution and trial work. He also has represented numerous Ohio public entities in a wide array of municipal and constitutional lawsuits. His practice also includes substantial experience representing a local television station in the First Amendment area. Mr. Friedman is listed in Chambers USA: America's Leading Business Lawyers 2003-2010 for his work representing owners in construction disputes and in the 2006-2011 editions of The Best Lawyers in America. He also appears in The Legal 500 US and Benchmark: Litigation. He has been listed as an Ohio Super Lawyer by Law & Politics each year since 2004 and is rated AV by Martindale-Hubbell. Prior to joining the firm, Mr. Friedman served as a judicial clerk for The Honorable Judge John M. Manos of the United States District Court for the Northern District of Ohio. He is a barrister in the John M. Manos American Inn of Court. Mr. Friedman is the co-founder and co-chair of the board of the Cleveland MetroKicks, a charitable soccer program for inner-city youth, and was a member of the charter class of the Cleveland Bridge Builders.

Molly Townes O'Brien
- A graduate of Brown University and Northeastern University School of Law, Molly Townes O'Brien served as a judicial clerk in the United States District Court and the Georgia Supreme Court before practicing law in Pennsylvania as a civil litigator and then as an Assistant Public Defender. She later was an Honorable Abraham L. Freedman Teaching Fellow at Temple University. In 1997, she joined the faculty of Emory University Law School and served as the Director of Advocacy Skills Programs through 2001. Ms. O'Brien has also served on the faculties of the University of Akron School of Law and University of Wollongong. Her primary teaching interests are in Education Law and Policy, Evidence, Trial Advocacy, Alternative Dispute Resolution and Criminal Law. She is currently an academic fellow to the International Society of Barristers, and a Research Fellow of the Constitutional Law Center at the University of Akron School of Law. She is former co-chair of the Clinical and Skills Education Committee of the American Bar Association Section of Legal Education and Admissions to the Bar. She has also served on the Ohio Supreme Court Task Force on Jury Service. She takes an interdisciplinary approach to the study of law and writes on issues relating to race, education, criminal law, and trial theory and practice.
