The Marshall County Grand Jury has charged Cindy Anderson Matthews and Mark Jacobs with first-degree murder of Scott Matthews, the husband of Cindy Anderson Matthews, last year on September 16, 2004.
The State alleges that the defendants were having an affair and plotted to kill Scott Matthews. Ms. Matthews was the sole beneficiary of her husband's estate.
The Matthews owned a home on a wooded lot overlooking Walden Pond in the Walden Estates subdivision. Matthews' body was found near the pond in the early morning hours of September 17, 2004. The coroner has placed the time of death between 8 p.m. and 10 p.m. on the evening of September 16, 2004.
Both of the defendants have entered pleas of not guilty. However, they admit that they were together during the time period in question.
The cases have been severed and the State is proceeding to trial against Cindy Anderson Matthews. Mr. Jacobs has indicated a willingness to waive his Fifth Amendment privilege and testify on behalf of Ms. Matthews.
