USDOL Publishes Final Regulations Implementing Notice Requirements Relating to Health Care Continuation Coverage (May 26, 2004); Technical Correction (June 23, 2004)
On May 26, 2004, the U.S. Department of Labor Employee Benefits Security Administration published in the Federal Register (69 FR 30083) a final rule amending 29 CFR Part 2590 to implement the notice requirements of the health care continuation coverage (COBRA) provisions of part 6 of title I of the Employee Retirement Income Security Act of 1974 (ERISA). As explained in the Federal Register document, the final regulations reflect some changes made by DOL, in response to public comment, to the proposed regulations and model notices that were published by DOL in the Federal Register on May 28, 2003 (68 FR 31831). The new final regulations are effective July 26, 2004. They apply to notice obligations arising under the COBRA provisions of part 6 of title I of ERISA on or after the first day of the first plan year beginning on or after the date that is six months after May 26, 2004. USDOL Publishes Final Regulations Implementing "White Collar" Exemptions Under FLSA
On April 23, 2004, at 69 FR 22121-22274 in the Federal Register, the U.S. Department of Labor published its long-awaited Final Rule under the Fair Labor Standards Act (FLSA) implementing the exemption from minimum wage and overtime pay for executive, administrative, professional, outside sales and computer employees, exemptions that are often referred to as the "white collar" exemptions. The Final Rule revises 29 CFR Part 541. As noted in the Final Rule, the new regulations are effective on August 23, 2004. The Federal Register document containing the Final Rule includes important background information in addition to the final regulations themselves.
