Veterans Benefits Law & Advocacy

Veterans Benefits, Health Care, and Information Technology Act of 2006

In December 2006, Congress repealed the 144-year-old law that prohibited attorneys from charging a fee for representing veterans in VA benefits claims. The Veterans Benefits, Health Care, and Information Technology Act of 2006 (Section 101 of Public Law 109-461) took effect on June 20, 2007. The law now allows attorneys to represent veterans much earlier in the VA claims process, and permits them to charge reasonable fees for the representation.

    This volume of Federal Veterans Laws, Rules and Regulations (FLVRR) first published in 1999. It is designed to make it economically possible for all advocates to have the latest version of statutes and regulations that govern the adjudication of claims for VA benefits.

    The FVLRR contains the entire Title 38 of the Code of Federal Regulations (C.F.R.). The FVLRR also contains the most important provisions of Title 38 of the United States Code Service (USCS). In addition, the FVLRR contains all of the rules of the United States Court of Appeals for Veterans Claims (CAVC or Court) and a comprehensive index. This revised edition of the FVLRR has been updated to cover changes to Title 38 through the Second Session of the 115th Congress and 38 C.F.R. through September 12, 2016.

    The statutes and regulations included in the FVLRR cover almost all issues regarding:

    •  service-connected compensation benefits;

    •  insurance benefits;
    •  specially adapted housing benefits;
    •  burial benefits;
    •  burial in a national cemetery;
    •  education assistance;

    •  appellate rights and due process;
    •  the rules governing the adjudication of claims for VA benefits; and

    For those taking appeals to the CAVC, a complete copy of the Court's rules is also included. This section should also be of interest to advocates who want to learn more about the CAVC.

    LexisNexis® Automated Veterans Benefits Forms
    LexisNexis® Automated Veterans Benefits Forms includes over 245 forms and value-added instructions written by National Veteran®s Legal Services Program (NVLSP) attorneys. New and revised forms are provided regularly.

    The repetitive typing, cutting, and pasting, and the increased chance of error that plague traditional methods of document preparation all disappear with HotDocs® document-assembly software. Simply enter case- or client-specific information once and HotDocs will insert it where relevant throughout the form. You will produce a signature-ready document in minutes. You can also save the information you have entered and use the saved answers to complete related forms. HotDocs will also compute many of the tax calculations automatically.
