The precedent has been prepared following the introduction of the reforms under the Personal Property Securities Act 2009 (PPSA) and takes into account the requirements under that Act.
It is based on the industry model deed prepared by the Australian Finance Conference (AFC) and the Australian Bankers' Association (ABA) updated in October 2012.
A partial release generally occurs where a grantor is selling some of its personal property to a purchaser. They may also occur where the grantor has given abundant security (e.g. security over all its property) to the secured party and wishes to release some of its personal property from the security interest.
This document can be used as a partial release of a security interest under a general security agreement or specific security agreement, or a partial release of a migrated transitional security interest under a fixed and floating charge or other security.
