    Before the government's recent increased focus on prosecuting individuals, there were few litigated cases involving the Foreign Corrupt Practices Act (FCPA). In recent years, however, there has been a significant increase in the number of defendants challenging FCPA charges. This pieces discusses three recent cases where defendants argued employees of state-owned entities do not fall within the definition of "foreign official" under the FCPA.

     

    Roger M. Witten, Kimberly A. Parker, and Jay Holtmeier are partners in the law firm of Wilmer Cutler Pickering Hale and Dorr LLP ("WilmerHale").
