    In a "pay for delay" settlement agreement, a patent holder pays an allegedly infringing generic drug company to delay entering the market until a specified date. The FTC has long challenged "pay for delay" or "reverse payment" agreements as anticompetitive, but generally have been unsuccessful. The In re K-Dur Antitrust Litigation decision is nevertheless a significant victory for the FTC and caused a split among the Circuit Courts.
