    In a unanimous opinion, the Supreme Court ruled that a provision in the Telephone Consumer Protection Act (TCPA) that authorizes private enforcement actions in state courts does not deprive federal district courts of federal question jurisdiction over such enforcement actions [see Mims v. Arrow Fin. Servs., LLC, -- U.S. --, 132 S. Ct. 740, 181 L. Ed. 2d 881, 2012 U.S. LEXIS 906 (Jan. 18, 2012)].

     

    Allan Ides is the Christopher N. May Professor of Law at Loyola Law School Los Angeles.
