    In AT&T Mobility LLC v. Concepcion (2011) 131 S.Ct. 1740, the Supreme Court ruled that the FAA preempted California’s Discover Bank  rule, which held waivers of class arbitration in consumer contracts unenforceable. The FAA prohibits conditioning the enforceability of arbitration agreements on classwide arbitration procedures. Few companies are likely to see an advantage to class arbitration. Congress may overturn the AT&T Mobility ruling.

     

    John Porter is a partner with Paul, Hastings, Janofsky & Walker LLP in its Tokyo office.
