    Recent cases have highlighted the unfairness that occurs when a fraudulent or voidable marriage still exists at the time of the decedent's death. This article discusses the history of the right of election and recent cases, such as Campbell v. Thomas (N.Y. A.D. 2d Dep't 2010) where the court has utilized equity to address these fraudulent marriages.

     

    Hon. C. Raymond Radigan, Ruskin Moscou Faltischek, P.C., retired Nassau County Surrogate, serves as counsel to the Trusts & Estates Department. He is chair of the Firm's Mediation Solutions Group. Judge Radigan's practice focuses on estate and trust litigation, estate administration, and estate planning.This article was co-authored by Jennifer F. Hillman, an attorney at Ruskin Moscou Faltischek, P.C. where her practice focuses in trust and estate litigation. The authors would also like to thank Jeffrey Gorak, whose recent research paper was the basis for this article. Mr. Gorak is a current student at St. John's University School of Law.
