    Design piracy has long been considered a problem by some in the fashion industry and a boon by others. Other than trademarked brand logos, fashion design has primarily been in the negative IP space. For years, many in the fashion industry have been pushing Congress to pass legislation that would give sui generis protection to fashion designs. Proposed legislation will leave designs created anywhere prior to enactment in the public domain.

     

    Janet Kim Lin counsels clients in the protection, licensing, and distribution of intellectual property. She represents firms in the design industry, including industrial designers, architects, and web designers. Janet drafts and negotiates technology and intellectual property agreements with a focus on copyright, trademark, and trade secret transactions. She has completed advanced legal coursework in Intellectual Property Law and Policy at the University of Washington. Her research included Advanced Patent, Trademark, Copyright, and Trade Secret Law; Trademark Practice; Strategic Licensing Agreements; Entertainment and Advertising Law; IP Litigation; Internet and Privacy Law, Virtual Worlds and Social Networks; and EU Community IP Law.

     

    Janet also has a background in the green building design industry and was one of the first attorneys in the country to achieve the LEED Accredited Professional designation. She frequently speaks at national legal and trade conferences on this topic. She previously served a three-year term as a Fellow with the American Bar Association Forum on the Construction Industry.
