    This commentary summarizes and analyzes the Strengthening Medicare and Repaying Taxpayers Act (SMART Act) signed into law by President Barack Obama on January 10, 2013. The SMART Act, which amends the Medicare Secondary Payer Act, seeks to alleviate Medicare conditional payment burdens in a great number of simple liability insurance settlements as well as ease the procedures for mandatory insurer reporting requirements.

     

    Jennifer C. Jordan, Esq. is General Counsel at MEDVAL, LLC, and the Editor-in-Chief of The Complete Guide to Medicare Secondary Payer Compliance (LexisNexis). She is a 2002 graduate of the University of Baltimore School of Law. She also holds two undergraduate degrees from the Virginia Polytechnic University and State University and a Master of Business Administration from the University of Baltimore Merrick School of Business. While eventually finding her own in the personal injury world, Jen actually pursued her law school education following a brief career as a graphic designer. After electronic media entered the mainstream, copyright and trademark issues became an everyday concern of designers and Jen's interest in the law began. Jen selected UB because it was the only local program with an intellectual property program complete with its own journal, which she eventually became editor-in-chief, while simultaneously maintaining a staff position on law review. Although obtaining concentrations in intellectual property and business law, Jen was already working in the structured settlement industry when the first CMS memo was published, and the rest is history. Jen has become recognized nationally as an expert in Medicare Secondary Payer compliance. She has been an invited guest speaker at numerous industry events, for individual and trade organizations, and is a trusted advisor to several state agencies. She provides formal continuing education programs for nationally recognized providers, such as Lorman Education Services and WorkCompCentral, in both the MSP and structured settlements. She has been invited to write for various journals and national publications, such as the American Bar Association's Tort, Trial and Insurance Practice magazine, The Brief. And most notably, her expertise has been recognized even by the United States Department of Justice, having been retained to consult in a constitutional claim brought against the Department of Health and Human Services in the Ninth Circuit in 2008. In 2010, Jen was named a LexisNexis Workers' Compensation Notable Person and in 2011, invited to be a member of the Larson's National Workers' Compensation Advisory Board.
