    Because one of the best forms of learning is hands-on, this book begins with a major casefile. Students are encouraged to immerse themselves in the details of the case, reflecting real litigation practice. The authors then outline the perception and reality of discovery abuse, and treat strategic professional judgment - the process of developing a discovery master plan. Succeeding chapters shift the focus primarily to tactical judgment.

    Each chapter begins with the text of the applicable Federal Rule of Civil Procedure and a brief review of the mechanics of employing that rule. Then, the reader is led through the chronology of using the discovery device in issue. At each major step in the chronology, the chapter highlights the choices facing the litigator and addresses the considerations that should influence the litigator's decision.

    Problems based on the hypothetical casefile comprise the end of each chapter. The Appendix provides additional problems based on other fact situations.
