    In a hospital or health care business chapter 11 case, the question of whether it is prudent and in the interests of the creditors, and often patients, to appoint a chapter 11 trustee to administer the estate in the stead of the debtor is often one that occurs early in the bankruptcy and that shapes the outcome of the restructuring.

     

    Adam C. Rogoff for more than two decades has focused his practice on complex transactional, litigation and advisory work relating to restructuring, commercial finance, Chapter 11 bankruptcy cases, workouts and "pre-packaged" Chapter 11 matters. He has extensive experience representing a broad range of corporate debtors, creditors (including DIP lenders), creditors' committees, and other parties in Chapter 11 restructurings and out-of-court workouts.

     

    Mr. Rogoff has extensive experience in healthcare and hospitals restructurings and his clients include Saint Vincent Catholic Medical Centers and its historic Manhattan hospital, nursing and rehabilitation homes, and behavioral health hospital. Mr. Rogoff also represented Bayonne Medical Center in its Chapter 11 restructuring. As debtors' counsel, he has also represented a major airline, a national hotel operator, numerous national retailers, and various manufacturers in steel, alcohol and metals mining. His creditors' committee clients include the Official Committee of Unsecured Creditors of both General Motors and Chrysler.

     

    Mr. Rogoff's outstanding record led Global Insolvency & Restructuring Review to name him one of its "Top 40 under 40" global insolvency practitioners in 2000. He was recognized as a leading lawyer by Legal 500 US 2010 and is listed in New York Super Lawyers (2006 – present). He is a frequent speaker and author of numerous articles and books on bankruptcy matters. Mr. Rogoff received his J.D. from New York University School of Law in 1988, Order of the Coif, and his B.A., with honors from Northwestern University in 1985.
