The Fifth Circuit briefly opened a window for recovery against the U.S., but then slammed that window shut in a new opinion holding that the FTCA's discretionary function exception completely insulates the government from liability. With that decision, the possibility of recovering Katrina-related damages against the United States appears to be extremely remote.

    The Hon. Robert C. Longstreth is a judge on the Superior Court of California, County of San Diego.
