    This Emerging Issue Analysis discusses the 2012 passage of Senate Bill 1003, which added to the Ralph M. Brown Act (open meetings law) a new administrative requirement of submitting a cease and desist letter to a local government agency accused of violation the Brown Act. These new provisions are pre-litigation requirements before seeking judicial action, and are designed to stop or prevent ongoing or threatened future violations of the Act.

     

    Professor Gregory Ogden is the author of Volumes 41 and 41A of California Forms of Pleading and Practice (Matthew Bender) on the subject of Public Administrative Law. Professor Ogden is a cum laude graduate of University of California at Los Angeles, and his J.D. is from the University of California at Davis School of Law. He joined the Pepperdine law faculty in 1978, as an associate professor of law. He became a professor of law in 1982. He was awarded the Chambership Fellowship in Legislation at Columbia School of Law, and received an LL.M. with a concentration in administrative law from Columbia in 1981. Since 2000, Professor Ogden has spoken at numerous continuing judicial education conferences on current developments in administrative law, evidence basics for administrative law judges, demeanor evidence and credibility determinations, and judicial ethics for ALJs. In 2006, Ogden was appointed Reporter for the Drafting Committee of the Model State Administrative Procedure Act revision project sponsored by the National Conference of Commissioners for Uniform State Laws (NCCUSL).
