    This new edition responds to a number of significant changes in the area. In the last four years, Congress has amended the IDEA to address issues of disciplinary removal, some procedural issues, and special education in private schools. Regulations for architectural design standards under the ADA have been revised. The Supreme Court has addressed employment discrimination, education, public accommodation issues, access to justice, and immunity. Lower courts have issued hundreds of opinions, primarily involving employment and education, but also increasingly addressing some of the areas that had previously not been the focus of substantial litigation.

    The Fourth Edition of Disability Law incorporates those major developments. It also reorganizes some of the material, particularly in the chapters on employment and housing to better facilitate teaching this material. In order to accommodate the increasing body of major judicial decisions, several of the cases from prior editions have been deleted and adapted as Note cases. Some have been edited further from the previous edition The text remains substantially the same in terms of approach and coverage. The goal is to introduce students to the major federal substantive law relating to nondiscrimination rights of individuals with disabilities. Most relevant Supreme Court decisions have been included as substantial excerpts or as Note references. Lower court decisions were selected to represent an array of disabilities in a variety of contexts. These excerpts illustrate either an unusual or particularly interesting approach to a case or as a decision that is given substantial deference by other courts. The selection of cases is intended to sensitize students and heighten awareness of what it means to have a disability and to dispel some of the myths and presumptions many have about individuals with disabilities.

    The Notes provide supplementary enrichment and background. Many are from popular media articles, demonstrating how this area of law touches everyone. The Problems are designed to encourage the student to apply the material to new situations. The goal is that the student learns not only the substantive law, but also considers policy and practical application.
