Defendant Michael E. Delia abruptly changed lanes and failed to reduce speed, causing a rear-end chain-reaction collision. The impact propelled a secondary vehicle (driven by David Sloop) into the rear of Plaintiff’s vehicle. Plaintiff alleged negligence including failure to keep a proper lookout, failure to maintain a safe following distance, and speeding. Defendant initially disputed the reasonableness and necessity of medical treatment and contested the proximate cause of certain soft-tissue injuries.

Blog Post: Genice Marie Horta v. George is 80 years old — a man of remarkable character whose life has been defined by service, adventure, and devotion to others. Though he never had children of his own, he played an integral role in raising his stepson, Jess, and the two share a close and loving bond to this day. George's story is one of a life fully lived. He served his country in the United States Army during the Vietnam War before embarking on a distinguished career in the film industry, working as a cameraman for nearly fifty years. His credits span some of the most iconic films and television productions of the 1980s, '90s, and 2000s. He remained active in the industry until just a few years ago, when he was diagnosed with mesothelioma. The sole defendant at trial, Mole-Richardson, was a manufacturer of theatrical and studio lighting that supplied approximately 95% of the lights used in Hollywood productions for much of its history. It used asbestos insulated "motion picture cables" and various other asbestos-containing parts in its lights which Plaintiff alleged caused his mesothelioma. Mole-Richardson was represented at trial by John Katerndahl and Brandon Sanchez of Gordon & Rees. The case was tried before the Honorable Judge Stephen Czuleger in Downtown Los Angeles over the course of nine court days. On Friday, February 27th, the jury deliberated for just two and a half hours before returning a unanimous verdict on all causes of action — including a finding of malice. The jury awarded $33,384,400 in non-economic damages and assigned 100% liability to Mole-Richardson. Economic damages were waived, and the matter resolved prior to the completion of Phase 2 of the punitive damages proceedings. Jamie Mattera and Sara Merrill traveled to Los Angeles from Weitz & Luxenberg's New York office for trial. They were joined by Tyler Stock from the firm's Los Angeles office. Jamie Mattera led the trial team with exceptional skill, delivering powerful opening and closing arguments, presenting Plaintiff experts Dr. Barry Horn and Dr. Steven Compton, and conducting brilliant cross-examinations of Mole-Richardson corporate representative Michael Parker and defense industrial hygienist Dr. Jeffrey Birkner. Sara Merrill handled the direct examination of George Stephenson with care and poise, and skillfully presented Plaintiff experts Dr. David Rosner and Dr. David Zhang. She was also highly effective in cross-examining defense historian Dr. Rachel Maines. Tyler Stock managed California law and briefing issues throughout the trial and delivered a masterful cross-examination of Mole-Richardson's final witness, defense pulmonologist Dr. James Crapo. Senior trial paralegal Keith Morriesette provided invaluable support throughout the proceedings, as did New York legal assistant Anell Paulino. Josiah Paker of the Los Angeles office also contributed meaningfully to closing preparations. This outcome is a testament to the teamwork, dedication, and unwavering commitment of everyone involved — and above all, to the trust George Stephenson placed in us to fight for him.

Blog Post: Peter Brutus v.
