On November 26, 2013, the Pennsylvania Supreme Court declined to hear an appeal of the Superior Court’s decision in Caldwell v. Kriebel Resources Co. [enhanced opinion available to lexis.com subscribers], which held that an oil and gas lease does not contain an implied duty to develop all strata.
