Next Generation Technology v. Johnson, Sept. 29, 2017 - "In this action, which is before this Court on consent pursuant to 28 U.S.C. 636(c), plaintiffs Next Generation Technology, Inc. (“NGT”) and Puspita Deo (“Deo”) (collectively, “Plaintiffs”) challenge, under the Administrative Procedure Act (“APA”), 5 U.S.C. §§ 701 et seq., the final decisions of the United States Citizenship and Immigration Services (“USCIS”), revoking its approval of an H-1B visa petition filed by NGT on behalf of Deo and denying NGT’s subsequently amended petition. ... For the reasons set forth below, the parties’ respective motions (Dkts. 26, 27) are each granted in part and denied in part, and this case is remanded to the agency for further proceedings consistent with this Memorandum and Order."
