Mealey's Elder Law - Contractor Denied Judgment On Pleadings In Nursing Home's Breach Of Contract Case

DETROIT - On remand from the Sixth Circuit U.S. Court of Appeals, a federal judge in Michigan on Aug. 28 denied a kitchen services contractor's motion for judgment on the pleadings on a nursing home's breach of contract claim stemming from the death of a resident who drank detergent she found in an unlocked cabinet, finding that the issues raised by the contractor cannot be resolved solely through the pleadings (Watermark Senior Living Retirement Communities, Inc. v. Morrison Management Specialists, Inc., No. 17-11886, E.D. Mich., Southern Div., 2019 U.S. Dist. LEXIS 146344).
