Mealey's Elder Law - Transfer Of Woman's Mineral Rights Resulted From Undue Influence, Texas Court Says

TEXARKANA, Texas - A Texas appeals court on June 20 affirmed a trial court's ruling finding that a deed transferring an elderly woman's mineral rights to a couple was void because it was the result of undue influence, holding that the evidence presented during trial showed that she would not have executed the transfer had she not been repeatedly pressured by the couple (Isabel Cortes, et al. v. Sharon Wendl, No. 06-17-00121-CV, Texas App., 6th Dist., 2018 Tex. App. LEXIS 4457).
