Mealey's Litigation Procedure - Class Certification Denied In Breach Of Express Warranty 'Natural' Labeling Suit

NEW YORK - A federal judge in New York on Sept. 12 denied a motion for class certification filed by consumers suing over the use of "natural" on labeling of Tom's of Maine Inc. personal case products, ruling that plaintiffs failed to show the damages they seek are incidental to the requested declaratory and injunctive relief and "neglected their burden" to provide sufficient evidence that would allow the court to decide if common questions predominate (Anne De Lacour, et al. v. Colgate-Palmolive Co., et al., No. 16-8364, S.D. N.Y., 2019 U.S. Dist. LEXIS 156099).
