Patents and Invention Reissue 1

New content for the first Reissue of this title, written by David Koedyk, has been published and is now available online. The newly reissued content offers essential guidance on the nature of, and applications for, patents, and applications for patents. The first six Chapters of the reissued title include an introduction to the legal framework for patents applying in New Zealand (Ch 1), followed by new content in relation to eligibility and ownership (Ch 2), types of application and requirements, including requirements of specifications (Chs 3 and 4), the necessary requirements that apply as regards patentability and what constitutes a patentable invention (Ch 5), and guidance on the publication and examination of application documents by the Commissioner of Patents. Content for the remainder of the title is currently in development and will be published in successive uploads as soon as it becomes ready for release until the reissued title has been completed in full, at which point it will also be published in hard copy format.

Perpetuities (Maximum Duration) and Accumulations

Updated content of for the “Perpetuities and Accumulations” title has been published (online only) in order to reflect that, although the Trusts Act 2019 abolished the common law rule known as “the rule against perpetuities” and repealed the Perpetuities Act 1964, thereby replacing the old regime governing perpetuities with a singular maximum duration period of 125 years, the former law may still be of interest, when considering the impact of the changes put in place by the 2019 Act. To this end, the “old” and “new” sets of rules applying to the law of perpetuities in New Zealand are considered in this title, which has been updated throughout by Dr Lindsay Breach, and has now been renamed “Perpetuities (Maximum Duration) and Accumulations”.
