We took the opportunity to ask the Authors a few questions.
Q: What are the most significant updates or changes in this edition?
It is so important to recognise the legislation covered applies to so many areas of practice, not just personal injury law. In the 6th edition, readers are provided not only with updated content on areas such as vicarious liability and scope of duties of care, but the text further expands on the application of proportionate liability provisions, identifying the differing positions taken by various appellate courts across Australia in developing the law in the area. In addition, the all-new Civil Liability Indexation Notice 2024 is included, with commentary on its application.
Q: Can you share an example of a challenging case or scenario where this book would be particularly useful for legal professionals?
The complexity that surrounds the application of the proportionate liability provisions means in any matter where multiple defendants may be liable, the 6th edition provides practitioners with guidance on the application of each provision, as well as on procedural elements such as evidential onus and pleading. Further, through its Appendices, the 6th edition remains imminently suited in assisting practitioners to quickly access $ calculations of injury scale values for both personal injury and worker’s compensation claims.
Q: What do you find most rewarding about working in this area of law?
The areas of litigation covered by the law within the 6th edition is so wide and varied in matter type that it is very intellectually stimulating. The added pay off of assisting a client to move through their issues to a just resolution also plays its part.

ABOUT THE AUTHORS
Richard Douglas KC is a Kings Counsel in practice at the Queensland Bar. He has appeared in many of the Queensland cases concerning the proper construction of the Civil Liability Act 2003 (Qld), the Workers’ Compensation and Rehabilitation Act 2003 (Qld) and the Personal Injuries Proceedings Act 2002 (Qld).
Gerard Mullins KC is a respected authority on personal injury and tort law in Queensland and has written and presented extensively on tort-related topics. He is currently a Kings Counsel in practice at the Queensland Bar and was formerly a lecturer and tutor in tort law at the Queensland University of Technology.
Simon Grant is a barrister in practice at the Queensland Bar. He was the government policy officer involved in the development of the Civil Liability Act 2003 (Qld) and its regulation. His work since that time has involved a wide range of civil liability, workers’ compensation, administrative law, resources law, and safety and health prosecution matters.
