"In sum, the Final Rule is vacated, and the vacatur is not limited to the State of Illinois. ... Given the Seventh Circuit’s holding that, despite the Supreme Court’s stay, the Final Rule was substantively and procedurally invalid under the APA and preliminary injunctive relief was appropriate, this court will not stay its vacatur of the Rule. ... Plaintiffs’ summary judgment motion is granted. The court enters a Rule 54(b) judgment vacating the Final Rule, to take effect immediately."
