- Federal: The Second Circuit holds that to survive summary judgment on a Title VII disparate treatment claim, a plaintiff may satisfy the third stage of the McDonnell Douglas burden-shifting test by providing evidence that even if the employer had mixed motives, the plaintiff’s membership in a protected class was at least one motivating factor in the employer’s adverse action. See Bart v. Golub Corp., 2024 U.S. App. LEXIS 7107 (2d Cir. Mar. 26, 2024).
- Federal: OSHA publishes a final rule amending its Representatives of Employers and Employees regulation to clarify that (1) employee representatives during a walkaround workplace inspection may be an employee of the employer or a non-employee third party, and (2) the third-party representative authorized by employees may have a variety of skills, knowledge, or experience that could aid the inspection. See 89 Fed. Reg. 22558 (Apr. 1, 2024).
