Caution: Uneven Road Ahead! Investigating C-Suite Executives
Learn more about the problems that can arise during C-suite investigations of executives. Routine and typical questions, such as who is the client, who has a need to know, how to protect privilege, and how best to close the investigation, can quickly present atypical problems in this complicated space. If termination is a possibility, and the executive is covered by an employment agreement, reviewing the “for cause” termination provisions of the executive’s agreement or terms of employment may be in order.

T of Pub. L. No. 117-328). Unless an exception applies, 401(k) and 403(b) plans established after December 28, 2022, must offer an "eligible automatic contribution arrangement" with automatic escalation and permissible withdrawal features starting with the 2025 plan year.
- Proposed Regulations: Using Forfeitures in Qualified Retirement Plans The U.S. Treasury Department and IRS have released proposed regulations (REG- 122286-18) relating to the use of forfeitures in qualified retirement plans, including a deadline for the use of forfeitures in DC plans.
