- Federal: The Department of Labor Wage and Hour Division will no longer request liquidated damages in any pre-litigation investigation or resolution. See Field Assistance Bulletin No. 2025-3.
- Florida: Florida enacts the Contracts Honoring Opportunity, Investment, Confidentiality, and Economic Growth (CHOICE) Act, which expands the enforceability of non-compete agreements. It allows non-competes to last up to four years and mandates courts issue preliminary injunctions against violations unless the employee proves no unfair competition. The law introduces "garden leave" clauses—permitting employers to require advance resignation notice of up to four years while continuing pay. It applies to employees and contractors earning over twice the average county wage, excluding health care workers. See 2025 FL H.B. 1219.
