- Federal: The NLRB overrules Tri-Cast, Inc., 274 NLRB 377 (1985),and reverts to a prior, case-specific test to evaluate whether employer statements about the negative impacts of unionization are unlawful threats. Under the new standard, such statements must be "carefully phrased on the basis of objective fact" and relate to probable consequences out of an employer's control. See Siren Retail Corp. d/b/a Starbucks, Case No. 19-CA-290905.
- New York: New York votes to amend the state constitution to prohibit discrimination based on ethnicity, national origin, age, disability, and sex, including sexual orientation, gender identity, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy. The amendment also allows laws to prevent or undo past discrimination. See Proposal 1 (Prop 1), also known as the Equal Rights Amendment.
