- Michigan: Michigan Court of Claims holds that the state legislature's amendments to voter initiatives regarding sick leave and minimum wage, which became effective in 2019, are unconstitutional. Accordingly, the original versions of the Earned Sick Time Act and the Improved Workforce Opportunity Wage Act will become law. However, the court stayed the effects of its decision until February 2023 to provide time for employer compliance. See Mothering Justice v. Dana Nessel, No. 21-000095-MM (Mich. Ct. Cl. July 29, 2022).
- Nevada: Nevada Supreme Court holds that use of recreational marijuana is not a lawful activity for the purposes of the state’s law protecting employees from discrimination for lawful off-duty conduct. Ceballos v. NP Palace, LLC, 2022 Nev. LEXIS 55 (Aug. 11, 2022).
