Why Ericsson DPA Breach Is Precedent-Setting
Companies found to have violated the Foreign Corrupt Practices Act (FCPA) may be offered a deferred prosecution agreement (DPA) by the U.S. Department of Justice (DOJ). DPAs typically impose ongoing obligations on the violator, such as obligations to make further disclosures about FCPA-violating conduct and to implement effective internal accounting controls. Read this article for details about Ericsson’s violation of its DPA obligations and how the DOJ looked at a period before entering into the DPA as well as afterward to determine that the DPA had been violated.
