DECISION

Denying Institution of Inter Partes  Review

I. INTRODUCTION

A. Background

Vitro Packaging, LLC ("Petitioner") filed a Petition to institute an inter partes  review of the sole claim of  U.S. Patent No. D526,197 (Ex. 1001, "the  '197 patent"). Paper 1 ("Pet."). Patent Owner, Saverglass, Inc., the assignee of record, ¹ has filed a Preliminary Response in this proceeding.

We have authority to determine whether to institute an inter partes  review under  35 U.S.C. § 314 and 37 C.F.R. § 42.4(a). Upon consideration of the Petition, we determine that Petitioner has not established a reasonable likelihood of prevailing on the claim challenged in the Petition. For the reasons expressed below, we deny institution of an inter partes  review of the sole claim of the  '197 patent.

B. Additional Proceedings

Petitioner states that Patent Owner has filed a lawsuit asserting the  '197 patent against Petitioner in Saverglass, Inc. v. Vitro Packaging, LLC., Civil Action No. 2:14-cv-05434-WFK-AKT in the Eastern District of New York. Pet. 1; see also Paper 9, 2 (Patent Owner identifying same related matter).(E.D.N.Y. 2014). Pet. 1.

C. The  '197 Patent and Claim

The  '197 patent, titled "Bottle, " relates to the design of a bottle. Ex. 1001, 1 (Figure Description). Figures 1 and 2 of the  '197 patent, illustrating perspective and front elevation views of the bottle, are reproduced [*3]  below.

Figure 1 depicts "a top, side perspective view of a bottle. " Ex. 1001, Fig. Desc.

Figure 2 depicts "a front elevational view" of the bottle. Id.
