Fleet Connect Sols. LLC v. Waste Connections US, Inc.

Fleet Connect Sols. LLC v. Waste Connections US, Inc.

United States District Court for the Eastern District of Texas, Marshall Division

June 29, 2022, Decided; June 29, 2022, Filed

CIVIL ACTION NO. 2:21-CV-00365-JRG

Opinion

ORDER

Before the Court is Defendant Waste Connections US, Inc.'s ("Defendant") Opposed Motion to Compel Document Production (the "Motion"). (Dkt. No. 54.) In the Motion, Defendant seeks an order compelling Plaintiff Fleet Connect Solutions, LLC ("Plaintiff") to produce certain categories of documents relating to the Asserted [*2]  Patents1 , including prior licenses, license negotiations, infringement contentions in other litigation, and financing agreements. (Id. at 2.) Having considered the Motion and subsequent briefing, and for the reasons stated below, the Court finds that this Motion should be GRANTED-IN-PART and DENIED-IN-PART.

I. BACKGROUND

The Court entered a Discovery Order and a Docket Control Order in this case on January 28, 2022. (See, e.g., Dkt. Nos. 24, 25.) Defendant contends that as of February 11, 2022, Plaintiff had not produced any relevant documents, prompting Defendant to reach out several times to "remind Plaintiff's counsel of its [discovery] obligation." (Dkt. No. 54 at 2.) Plaintiff disagrees and argues that it has been producing documents "going as far back as November 16, 2021," including license agreements, patents, file histories, assignment histories, and infringement contentions. (Dkt. No. 57 at 2.)

The parties met and conferred on April 19, 2022 and Defendant filed the instant Motion on June 8, 2022 on the basis that Plaintiff has "confirmed that it will not produce certain categories of documents" that Defendant now seeks. (Dkt. No. 54 at 2-3.) Plaintiff contends that [*3]  the documents sought by Defendant are either irrelevant or privileged. (Dkt. No. 57 at 1.)
