    Brehm v. Eisner

    Order affirmed in part, reversed in part, and remanded to allow plaintiffs to replead facts creating a reasonable doubt that a board of directors' decision allowing non-fault termination was protected by the business judgment rule. The dismissal with prejudice was affirmed in all other respects.

    Court reversed appellate court's decision, finding insurer not obligated to provide insurance to petitioner for petitioner's violation of unfair competition statute arising out of its advertising activities because allowing petitioner to pass loss to insurer would destroy incentive for petitioner to obey unfair competition statute.

    Aronson v. Lewis
