Resources for Complying with the California Consumer Privacy Act (CCPA)

The passage of the California Consumer Privacy Act (CCPA) on June 28, 2018, has been widely described as a watershed moment in U.S. privacy law. As one of the broadest consumer privacy laws passed in the United States to date, the Act represents significant compliance challenges for companies that engage with residents of California. The law, which goes into effect on January 1, 2020, includes burdensome new obligations on businesses and creates new hard-to-meet consumer privacy rights, such as rights to data access and data deletion. In the next six months, companies will need to take stock of their data collection practices, update their privacy notices, policies and procedures, and take other actions to conform to the requirements of the CCPA.

Making the compliance challenges even worse, the CCPA was passed quickly to avoid being enacted through a ballot initiative, and has been criticized as hastily drafted with errors and inconsistencies. It has been the subject of several technical amendments in the California legislature already, and could go through additional updates before taking effect. Under the law, the California Attorney General is also tasked with passing implementing procedures, the deadline for which has been extended until July 1, 2020. The hurdles placed before businesses racing to comply are therefore very high, and attorneys counseling those entities will need up-to-date analysis and practical guidance they can count on to meet their deadlines.
