Don’t Let Time Pass You By: Antitrust and Statutes of Limitations

July 15, 2025 (2 min read)

Time is fleeting—by definition. Before you know it, antitrust claims can become stale. And antitrust statutes of limitations (SOLs) may bar them as a matter of law. As a litigator, whether for plaintiff or defendant, it is therefore critical to understand the antitrust SOLs (and the related concept of laches) and the doctrines that can defeat them. These concepts are especially important in conspiracy cases in which illegal activity is concealed.

Learn in-depth about SOLs and related doctrines such as the discovery rule, continuing violation doctrine, equitable tolling, laches, and fraudulent concealment by reviewing the new Antitrust and Statutes of Limitations practice note as well as our other materials on antitrust litigation in Practical Guidance - Antitrust: Civil Antitrust Litigation. The practice note addresses the legal standards for these tools as well as their strategic use.
