Wearable Recording Device Privacy Bill Nears Passage in CA

A fast-moving bill (SB 1130) in California would make it a misdemeanor to use a wearable recording device to capture sound or video of another person anywhere within a place of business where there is a reasonable expectation of privacy without that person’s explicit consent. Violators would face penalties of up to a year in jail, a fine of up to $1,500, or both. The bill would also make disabling a recording indicator on such a device a misdemeanor and impose civil penalties of up to $2,500 per violation for manufacturing, selling or using technology designed to disable a recording indicator.

The bill has been passed by the Senate and a pair of Assembly committees. It is one of several measures dealing with smart glasses or wearable recording devices that SNCJ reported on earlier this year. (JACKSONLEWIS, LEXISNEXIS STATE NET)
