"U.S. Citizenship and Immigration Services (USCIS) is issuing policy guidance in the USCIS Policy Manual to provide comprehensive guidance on the H-3 trainees nonimmigrant visa category.
Background
This new guidance on the H-3 visa category consolidates all previous guidance addressing circumstances under which a temporary worker may come to the United States as a trainee or as a participant in a special education program.
The new guidance contained in Volume 2 of the Policy Manual consolidates the guidance in Adjudicator’s Field Manual (AFM) Chapter 31.6 and any related USCIS policy memoranda. The new Policy Manual guidance supersedes AFM Chapter 31.6 and all related policy memoranda.
Policy Highlights
- Consolidates previous guidance on the H-3 nonimmigrant visa category, to include guidance on the background, purpose, and legal authorities of the H-3 program.- Provides guidance on the H-3 program requirements, descriptions, and restrictions, and includes a list of forms and documents for the H-3 visa petition.
