“Insurance litigation saw several pandemic-related spikes in 2021 and 2022 as certain types of coverage were in the spotlight. As we move further away from those years, different patterns are emerging with respect to the types of coverage that are the subject of litigation in the federal courts,” said Ron Porter, Lex Machina Practice Lead for Insurance Litigation Analytics.
Indeed, litigation trends in federal courts for 2022 through 2025 reveal a changing world of coverage disputes, resembling neither early Covid-19 years nor the preceding period in important ways.
“The Insurance Litigation Report offers a detailed and comprehensive analysis of the trends influencing insurance litigation in federal courts,” said Sue Zago, Law Library Director and Professor of Law at the University of New Hampshire Franklin Pierce School of Law. “Utilizing the power of Lex Machina, this report provides an extensive dataset that enables lawyers to monitor trends among leading law firms and judges in areas such as general insurance, business liability, business interruption, hurricane-related claims, homeowners policies, and life insurance policies.”
Lex Machina, the LexisNexis® Legal Analytics® platform, empowers legal professionals to make data-informed decisions for claim assessment, venue selection, motion strategy, settlement negotiations, trial tactics, business development, lateral hiring, and more. We provide companies and law firms with advanced intelligence on case outcomes in federal courts and over 100 state trial courts, along with the experience metrics that make each judge, attorney, and party unique. Lex Machina gives law offices a competitive edge against peer firms for dispute-resolution strategy and business development.
“Lex Machina gives us the ability to understand how our judge will likely rule. We look at the past motions the judge has granted or denied, and we look into their reasoning behind them,” said attorney Jas Jordan. “It puts us in a better position to predict the possible outcome for our motion.”
In a 2025 survey of law firm attorneys and professional staff, over 95% of respondents agreed that analytics are valuable to their practices. Seven of ten professionals reported that clients now expect them to use litigation analytics while working on their matters.
