Artificial Intelligence (AI) in the Workplace Video

March 18, 2024 (1 min read)

By: Katherine Smith and Emily M. Lamm, GIBSON DUNN

This video outlines key considerations regarding artificial intelligence (AI) in the workplace.

The video discusses how AI is being used across the employment lifecycle, legislative developments regarding AI in the workplace, and best practices to reduce the potential risks of using AI in the workplace.

To advise developers and deployers of AI systems and tools, you must first understand how companies and individuals are implementing AI across the employment lifecycle. Here are three basic examples.

  • First, AI powered chatbots, such as ChatGPT, simulate conversations with human users, and generate outputs in response to questions. Chatbots are used to facilitate or replace certain HR functions, including scheduling, communicating with candidates during the application process, and guiding employees through onboarding.
  • Second, AI video interviewing is being used to allow employers to streamline the application process by conducting screening interviews.
  • Third, AI resume screening is a popular way for employers to manage and review a massive volume of applications by sorting through them based on specific characteristics, such as job-relevant work experiences and skills, the efforts in three jurisdictions to regulate the collection of biometric data, use of facial recognition services, and employers’ use of automated employment decision tools in hiring and promotion.

Katherine Smith is a partner in the Los Angeles office of Gibson, Dunn & Crutcher. Katherine serves as co-chair of the firm’s Labor and Employment Practice Group.
