Fox joins LexisNexis from WilmerHale, where he was most recently counsel in the firm’s appellate litigation group. His experience includes a significant number of patent appeals involving many different technologies, as well as matters involving administrative law, commercial litigation, and civil rights.

For the past two years, Fox was recognized on the Best Lawyers: Ones to Watch list, and he was repeatedly named to the District of Columbia Bar’s honor roll for his commitment to pro bono work. Earlier in his career, he clerked at the federal district court in Delaware and at the Federal Circuit in Washington, DC. He obtained his JD from the University of Michigan Law School and is admitted to the District of Columbia Bar and New York State Bar.

Lex Machina 2026 Product Liability Litigation Report: Non-MDL Federal Filings Reach a Ten-Year High as Vehicle Warranty Cases Drive Activity

San Jose, CA, September 15, 2026 — LexisNexis^® Legal & Professional announced today the release of the Lex Machina^® 2026 Product Liability Litigation Report, a comprehensive, data-driven analysis of trends shaping U.S. product liability litigation in federal district and circuit courts, with additional insights exploring trends in the especially busy Superior Court of Los Angeles County. The analysis explores trends in 813,960 product liability cases in federal district courts, 3,102 federal circuit court cases docketed from 2016 through 2025, together with 36,939 product liability cases in Los Angeles Superior Court.

Powered by insights from Lex Machina^®, the LexisNexis^®Legal Analytics^® platform, the report dissects trends dating back to 2016 and provides timely observations from the first half of 2026. The analysis explores shifts in filings, appeals, timing, resolutions, findings, and damage awards, along with details regarding the judges, parties, and counsel most involved in federal product litigation.

Key findings from the report include:

Federal product liability filing activity reached a new high in 2025, driven by vehicle cases: From 2023 through 2025, more new product liability cases were filed in federal district courts than intellectual property, labor and employment, and civil rights cases combined. Excluding cases associated with multidistrict litigation (MDLs), claimants filed 5,692 product liability cases in 2025, a 31% increase from 2024 and the highest annual total in the 2016-2025 period. Vehicle product cases rose to 3,281, up roughly 269% from 2016 and representing more than half of all non-MDL product liability filings in 2025.

Product liability damage awards rebounded above recent levels, but one extraordinary judgment dominated the total: Courts awarded $2.976 billion in product liability damages across 38 cases in 2025, more than double the $1.338 billion awarded across 39 cases in 2024 and above the $2.044 billion awarded across 52 cases in 2023. The 2025 total was the highest since 2017, though a single judgment for approximately $2.53 billion accounted for most of that sum. From 2023 through 2025, court-ordered awards and approved class action settlements exceeded $6.37 billion in principal damages.

California has seen a remarkable surge in product liability lawsuits: The Central District of California received 3,004 non-MDL product liability cases from 2023 through 2025, or 21.2% of the national total and more than three times the volume of any other federal district. California’s four federal districts together accounted for more than one-third of all such cases. In Los Angeles Superior Court, annual product liability filings increased from 479 in 2021 to 11,822 in 2025, with most recent actions filed against automakers under the Song-Beverly Consumer Warranty Act.

“Product liability litigation rarely follows one simple path,” said Eric Wright, senior vice president for Lex Machina at LexisNexis. “In the latest data, the trends behind case volume, duration, and damages vary sharply between MDL and non-MDL matters, different types of claims, and individual venues. Lawyer preference for AI grounded in legal sources rises to 81%

· Four in five lawyers (81%) say they feel more comfortable using AI when it is grounded on legal sources, up from 70% this time last year

· Hallucinations are the top concern, while 77% believe AI is causing clients or the public to misinterpret the law

· 94% of lawyers now use AI for legal work, with 74% using it at least once a week

LONDON, 02 September 2026 – LexisNexis® Legal & Professional, a global leader in information, analytics and AI-powered legal workflow solutions, has published new research showing that lawyers are placing growing importance on AI that is grounded in trusted legal sources.

The 2026 survey of 543 legal professionals found that 81% feel more comfortable using AI when it is grounded in legal sources, up from 72% in January 2026 and 70% this time last year.

At the same time, concerns are growing about AI contributing to misinterpretation of the law. More than three-quarters of respondents (77%) believe AI is causing clients or the public to misinterpret the law.

Accuracy remains the profession’s biggest concern. 83% of respondents worry about lawyers relying on inaccurate or fabricated information, significantly ahead of concerns about confidential-data leakage (53%) and becoming too reliant on AI (52%).

AI use is now firmly mainstream. 94% of lawyers use AI for legal work, with 74% using it at least once a week and 34% using it every day. One in ten (10%) say they are now dependent on AI to do their job.

Legal research remains the leading use case, with 69% currently using AI for this work, followed by document summarisation at 62%, while drafting and document review are both at 53%.

The proportion of organisations with AI embedded in strategy and operations has risen sharply, from 17% in January 2026 to 29% today.

The findings also suggested that these AI strategies could have an impact on talent retention. 46% of lawyers say their career would be negatively affected if their organisation failed to fully embrace AI, up from 28% this time last year. Meanwhile, 22% say they would consider leaving an organisation that failed to embrace AI, up from 16% a year ago.

The survey also highlighted shifting expectations around the commercial impact of AI. 55% of lawyers now believe law firms will change how they bill because of AI, compared with 40% in January 2025.

The report’s editor, Dylan Brown of LexisNexis, says:

“The findings point to a legal profession that is becoming more comfortable with AI, but more demanding about the trust, accuracy and authority behind it. As adoption accelerates, lawyers increasingly want AI tools that support rather than replace professional judgement.”

The Legal Professional’s Next Job Is to Build an Intelligence Advantage

From where I sit as general counsel, I don’t think about AI models, agents, and skills as separate technologies. I think about what my team needs to make the right decision.

That starts with authoritative legal intelligence and also everything our organization already knows: our agreements, policies, precedents, risk positions, prior decisions, and institutional expertise. Law firms face the same underlying challenge: how to combine authoritative legal intelligence, firm knowledge, client context, and professional judgment around a matter.

Today, too much time is spent finding that information, moving it between systems, rebuilding context, and turning it into usable work. New AI models, skills, and applications arrive every week, and none of them fix that on their own.

Lawyers do not experience their work as a stack of AI technologies. They experience a matter, a negotiation, a regulation, a decision the business needs by the end of the week. What matters more today is whether the technology can organize itself around the work: bringing together the right intelligence and context, applying the best capabilities to the matter at hand, and carrying the work forward.

When it does, the opportunity changes. For law firms, this means using intelligence to deepen expertise, preserve institutional knowledge, and deliver greater value to clients. For general counsel, our next job is not simply to make the legal department more efficient. It is to build an intelligence advantage.

That advantage means getting to the right authority, bringing institutional knowledge into the analysis, applying that intelligence consistently across the legal team, moving faster from issue to insight to decision to finished work, and removing friction without removing judgment.

The opportunity now goes well beyond efficiency. When a new regulation lands, my first question is not simply what it says. It is which of our agreements, products, markets, and commitments it touches, what has changed, and where we need to act first. This used to mean commissioning a project: scoping, staffing, and weeks of work. Now, it can begin as a simple question because the system can bring the matter documents, the legal research, our own prior positions, and the current external picture into one line of analysis, apply different capabilities to different parts of it, verify the supporting authority, and produce the fully formatted memo, spreadsheet, or presentation the matter requires.

Next-level work is not simply doing the same task faster. It is taking on more complex work, carrying more context through it, and getting to something the legal team and the business can act on sooner.

Professional-grade decisions
The profession has spent considerable time debating which AI model is smartest. The debate will continue, and the models will keep changing.

No experienced legal professional signs off on a consequential decision based on a model alone. From the general counsel’s seat, I need to know what the law says, whether the authority is current, and whether the citations exist and say what they are claimed to say. We need to know what the organization has done before, what risk it has historically accepted, what the relevant contract says, and that our confidential information stayed protected.

This is why the intelligence that surrounds the model matters more than the model itself. A regulatory development can be connected to the products, contracts, and jurisdictions it affects. A litigation outcome can be viewed alongside judicial history and the company’s existing exposure. A lawyer facing a new issue can draw on the organization’s prior positions without depending on whether the person who handled the last matter happens to be available.

That is how institutional knowledge becomes institutional capability. It is also how legal moves earlier into the decision. The value is not merely answering the question the business asks. It is seeing the question before the business knows to ask it.

Transformative economic impact
Legal AI has been sold almost entirely on productivity: fewer hours, less repetitive work, lower spend. Those savings are real, and I will take them. They are only the beginning.

When intelligence is connected, the economics change. Matters that went to outside counsel because we lacked the capacity to run them come back in. Expertise that once depended on a particular lawyer can be applied more consistently across the organization. Work that was once too expensive to perform may become commercially viable.

Law firms face the same shift from the other side. The question is not only what becomes possible, but how firms create and demonstrate value when more of the underlying work can be completed faster. The opportunity is to apply firm expertise more consistently, bring institutional knowledge to every matter, expand the range of work that is economically viable and focus lawyers’ time on judgment, strategy and client advice.

More interesting is the value already sitting in the organization, unclaimed. Rights in agreements no one has exercised. Terms that warrant renegotiation. A regulatory change that opens a commercial opportunity rather than creating a risk. Patterns across disputes and negotiations that reveal something about a counterparty or a market that no single matter would show.

That is a different proposition from saving thirty minutes on a draft. It is legal intelligence becoming an asset the business can act on.

The advantage has to be governed
The strongest legal AI systems will not simply become more autonomous. They will combine greater capability with authoritative grounding, verification, permissions, security, and professional oversight.

For general counsel and law firm leaders alike, that governance is not a technical detail. Deciding which sources carry authority, what these systems can reach and who can reach it, and what must be verified before it is relied on is what determines whether AI remains another collection of tools to manage or becomes an intelligence advantage that can be put to work.

The opportunity is to bring together the best technology, the best external intelligence and everything the organization knows, then turn that combination into next-level work, professional-grade decisions and transformative economic impact.

That is a much bigger ambition than making lawyers more efficient. It is the advantage legal professionals should be building now.

The Legal AI Journey: From Task-Specific Tools to Integrated Intelligence

Legal professionals have more powerful technology available to them than ever before. They also have more complexity to manage. AI has added another layer of complexity: model choice, agents, skills, and new ways to connect them.

The AI journey in legal started with simple tasks. Chat, research, summarize, check citations, and draft. Then models got larger and better at reasoning, with access to current information from the open web. Agents followed, handling multi-step work with more independence and coordinating with other agents. Repeatable AI workflows made it possible to connect tasks together and apply them at scale. Now, skills, plugins, and open standards like Model Context Protocol (MCP) connect AI to even more tools, data, and applications.

Each innovation matters. The harder problem isn’t whether AI can do one task well. It’s whether all of these capabilities work together the way legal professionals work.

Almost one in four people in England and Wales live in a legal aid desert

Analysis of local authority data finds that 14.49 million people in England and Wales, or 23.4% of the population, live in an area classed as a legal aid desert
Pattern of geographic inequality that mirrors wider regional disparities, with smaller, rural and coastal communities suffering the worst gaps.

LONDON, 18 August 2026 – LexisNexis^® Legal & Professional, a global leader in information, analytics and AI-powered legal workflow solutions, has published new research revealing that access to legal aid remains highly uneven across England and Wales.

The Legal Aid Deserts report uses the latest available public data to compare indicators of legal need with legal aid provider capacity. The analysis found that 91 local authorities are classed as legal aid deserts in at least one of the five areas analysed: housing, family, crime, immigration and employment. Together, these authorities are home to 14.49 million people, or 23.4% of the population of England and Wales.

37 local authorities, with a combined population of 5.38 million, fall into the lowest-scoring category in two or more areas. Eight local authorities are classed as legal deserts in four or more areas: Babergh, Breckland, Derbyshire Dales, East Cambridgeshire, East Devon, Rutland, South Norfolk and West Berkshire.

In practice, legal aid deserts are areas where there is a high need for legal support, but access to legal aid provision appears comparatively weak. For people living in these areas, the consequences can be severe: a tenant facing unlawful eviction with no solicitor, a parent navigating a custody dispute without representation, or a worker dismissed unfairly with no route to redress. For most, the alternative to legal aid is no legal help at all.

The report highlights significant pressure across individual areas of law. It found that 6.6 million people live in housing legal aid deserts, 4.2 million live in family legal aid deserts, 3.6 million live in crime legal aid deserts, 4.6 million live in immigration legal aid deserts, and 4.1 million live in employment legal aid deserts.

The findings suggest that the sharpest access gaps are often concentrated in smaller, rural, coastal and semi-rural authorities, where provider capacity appears limited relative to legal need. Regionally, the weakest-performing authorities are concentrated most heavily in the East of England, the East Midlands and parts of the South East, with further pressure points in the South West. London, by contrast, is largely absent from the most acute legal aid desert lists.

Commenting on the importance of accessible legal aid, Kirsty Brimelow KC, Chair of the Bar Council of England and Wales, said:

“Legal aid is a vital part of the justice system, meant to ensure that everyone receives the support they need to access justice, regardless of their financial situation. It provides equality of arms between parties trying to resolve their disputes and enables citizens to exercise their rights through the courts.”

“Legal aid deserts reduce access to good quality legal advice at the early stages of proceedings, which in turn causes poor case management decisions and delays to both the case and its resolution.”

Jasmine Basran, Head of Policy and Campaigns at the national homelessness charity Crisis, said:

"Being able to access housing legal aid can be the turning point that helps someone out of homelessness or helps them avoid it altogether. Early legal advice can stop an eviction becoming a homelessness application. Without it, problems that could have been resolved cheaply and early can spiral, forcing people into temporary accommodation at far greater cost to the person and to the public purse.”

“This report provides a critical update on legal aid across England and Wales. Even where housing legal aid exists, far too often it's out of reach.”

Methodology
The analysis draws on public data on legal aid provider locations, population, local authority geography and area-specific indicators of legal need across housing, family, crime, immigration and employment. For each practice area, the model compares estimated legal need with local legal aid provider capacity, adjusts for population, and applies a 15 km catchment rule to reflect nearby access to support. Local authorities in the bottom 10% of the resulting access measure are classified as legal aid deserts.

Lex Machina 2026 Patent Litigation Report: District Court Filings Reach a Ten-Year High as PTAB Activity Slows Sharply

San Jose, CA, August 5, 2026 — LexisNexis^®Legal & Professional announced today the release of the Lex Machina^® 2026 Patent Litigation Report, a comprehensive, data-driven analysis of trends shaping U.S. patent litigation in federal district and appellate courts and before the Patent Trial and Appeal Board (PTAB). Powered by insights from Lex Machina^®, the LexisNexis^® Legal Analytics^® platform, the report examines key developments from 2023 through 2025, places those findings in historical context dating back to 2016, and includes current observations from the first half of 2026. The analysis encompasses 38,893 patent cases filed in U.S. district courts and 3,589 federal circuit court cases docketed from 2016 through 2025, together with PTAB petitions and appeals.

Key findings from the report include:

District court patent filings reach a ten-year high before pulling back in 2026: Plaintiffs filed 4,547 patent cases in 2025, a 19.6 percent increase over 2024 and the highest total in the 2016–2025 period. From January 1 through June 30, 2026, claimants filed approximately 1,900 new patent lawsuits, putting 2026 on pace to finish comfortably below the record level reached in 2025.

Patent damages remain above $2 billion for a fourth consecutive year: Courts awarded $2.353 billion in patent damages across 63 cases in 2025, excluding fees and interest. From 2023 through 2025, reasonable royalty awards totaled $8.156 billion, with $8.066 billion awarded through verdicts, underscoring the continuing role of juries in the highest-value patent recoveries.

PTAB activity enters a sharp slowdown: Inter partes review petitions fell approximately 8 percent to 1,208 in 2025, while post-grant review petitions increased to 75, their highest level since 2021. In the first half of 2026, parties filed only 201 PTAB petitions—fewer than in any other half-year period in at least a decade.

From Chat to Work: Why Trust Is the Real Shift in Legal AI

Something shifted in legal AI over the past year. The shift is not about which model is most capable, or which platform has the most features. It is about what lawyers are actually asking AI to do.

From Answers to Outcomes

The way I describe first-generation legal AI is a sage sitting on a hill. You climb up, you ask a question, you get an answer, and you walk back down to do something with it yourself. The AI gave you knowledge. You still had to do the work.

Agentic AI brings the sage off the hill and into the workshop. When you ask them to do something, they act – they research, draft, verify citations, ask follow-up questions, and hand back something close to finished work product. You are not getting a response to carry back and act on. The work is getting done.

This matters because lawyers are not trying to produce AI outputs. They are trying to produce a brief, a contract review, a client memo. The gap between what AI returns and what a lawyer actually needs to deliver is what agentic workflows close. And that is a very different kind of value from what the first generation of legal AI was offering.

Trust Is Not a Feature – It Is the Prerequisite

Here is the challenge: agentic AI that closes the gap only matters if it does so reliably.

Moving from chat to work raises the stakes on accuracy in a specific way. When AI is answering questions, a lawyer can evaluate the response and decide what to do with it. When AI is producing work product, the verification layer has to be part of the workflow itself – not something added at the end.

Before a lawyer relies on any authority, two questions have to be answered: is this citation real, and is it still good law? Getting those answers used to mean a separate research step. With Shepard's® Verify, those signals appear in context, as part of the work. Upload a brief from opposing counsel, and Protégé checks every citation against our database: does it exist, is it still valid, how have subsequent courts treated it? The lawyer does not break flow to go verify. Verification comes to them.

That is the architecture that makes agentic legal AI usable in practice. Lawyers will adopt tools they can move quickly with – and they can move quickly when they can verify everything. Trust does not slow down the work. It is what makes the speed possible.

A Different Kind of Competitive Advantage

One of the most interesting things happening right now is how legal organizations are thinking about the model and platform question. A lot of firms have been experimenting with point solutions: a tool for research, a different one for drafting, another for review. What we are hearing increasingly is that clients want fewer tools, not more. They want something that can hold their way of working, not just a generic capability they have to configure from scratch every time.

The layer that matters in that context is not which foundational model is running. It is how well the platform understands legal work. A good platform should be able to draw on whichever model serves a particular use case best. What does not commoditize is legal content. Two hundred billion documents, four million added daily, 150-plus years of Shepard's intelligence. That is the fuel that makes the model actually useful for legal work.

Firms are also beginning to understand that they can bring their own way of working into the platform. Their playbook – the way their practice group approaches a particular matter type – can become a skill that the agent draws on. That is a meaningful shift from using a generic AI tool to using one that actually reflects how a firm works.

What This Means for the Work Ahead

I am genuinely optimistic about what agentic legal AI makes possible over the next few years. Some of this is work that simply did not exist before. For example, litigation strategy built on judge-specific outcome data and regulatory signals embedded in live deal documents. And some of it is about who gets access to legal expertise at all. Law is underserved in many parts of society, and AI that lawyers can trust and verify gives the profession capacity to serve more people in more places.

Also, junior lawyers are going to develop faster. For example, working through mock trials, mock depositions, richer training environments, getting to senior-level judgment more quickly than previous generations could. The floor of the profession rises.

But none of that happens unless lawyers trust the work being produced. The real shift in legal AI is not from one model to another, or from one feature set to the next. It is the move from answering questions to helping lawyers get work done. As AI moves from chat to work, trust becomes more than a requirement. It becomes the foundation that makes the entire transition possible. The measure of a legal AI platform is not what it can generate. It is what a lawyer can confidently put their name on.

Private law firms led for jury trial awards in federal courts: For jury-awarded damages, private law firms dominate the list of top earning law offices from 2023 to 2025, with ten law firms each directly responsible for achieving more than $1 billion in principal damages via plaintiffs’ jury verdicts in federal courts from 2023 to 2025.
Massive jury verdict awards in Los Angeles Superior Court: From 2023 through 2025, plaintiffs secured more than $2.4 billion in principal damages through jury verdicts in Los Angeles Superior Court alone, underscoring the scale of high-exposure civil litigation in one of the nation’s busiest trial courts.

What We Learned from Evaluating MCP-Based Workflows for Authoritative Legal AI

At LexisNexis, we believe legal AI must do more than generate plausible answers. It must produce work lawyers can verify, defend, and trust.

That principle – AI held to the standard of law – guides every technology decision we make, including which external integrations help us better meet our customers’ need for legal authority, and which require further development before they are ready for customer-facing legal workflows.

Model Context Protocol, or MCP, is an open standard that enables AI systems to connect with complementary tools, data sources, and resources to help users complete tasks. As MCP-based integrations become an increasingly common architecture across legal AI, we have been testing how they perform in practice – especially in workflows where accuracy, attribution, consistency, and defensibility matter.

Our Approach: Continuous Evaluation, Selective Integration

Lexis+ with Protégé is an ecosystem-based legal AI platform. It brings together capabilities developed by LexisNexis, as well as capabilities contributed by technology partners, including Anthropic, where they demonstrably serve our customers’ needs.

The May 7 launch of the next evolution of Lexis+ with Protégé and the May 13 announcement about the integration of Anthropic’s Claude legal plugin suite into the platform both reflect that philosophy. We believe in ecosystem-based innovation, and we integrate external capabilities selectively – when they strengthen the legal work our customers need to perform.

That also means we test rigorously before we ship. We work closely with partners across the AI ecosystem to evaluate emerging capabilities against the standards legal work demands: citation accuracy, output consistency, grounding in authoritative sources, and clear attribution between what LexisNexis content supports and what a model generates independently.

MCP Testing: Our Criteria for Integration

When evaluating potential MCP connector integrations, we run methodical side-by-side comparisons across three configurations: the LLMs alone, LLMs with our MCP connector, and Lexis+ with Protégé.

In testing, if an LLM has access to our MCP connector – and introduces additional legal interpretations, adjacent statutes, or citations not provided by LexisNexis – our criteria for moving forward with an integration is not met. The same is true if the resulting output could reasonably lead a user to believe the full response was grounded in LexisNexis authority, when portions were generated independently by a model.

In addition to attribution ambiguity, consistency is another important consideration. Asking the same legal question multiple times through an LLM should not produce meaningfully different outputs. We require the same performance of Lexis+ with Protégé; each response to a given prompt should remain consistent and tightly tied to authoritative support.

For legal work, this difference matters. It can be the difference between work product a lawyer can confidently validate and output that requires additional scrutiny before use.

Why Authoritative Grounding Is Non-Negotiable

We are careful not to present authoritative LexisNexis content alongside model-generated material in ways that could blur attribution or undermine user confidence. This is not a competitive posture. It is a way of ensuring that we assist our customers in meeting their professional obligations.

Lawyers rely on LexisNexis because our legal AI is verifiable, citable, and connected to trusted legal authority. When a user cannot clearly distinguish between what LexisNexis has verified and what a model has generated independently, the trust that makes our legal AI useful is weakened – and the lawyer’s work product may carry risk the user cannot easily see.

AI without deep legal authority and built-in ability to verify can accelerate work. It can also accelerate the need for review. The pace of AI development is genuinely exciting, and we are deeply engaged with it. Our customers’ professional reputations depend on the verifiability, attribution, and integrity of every AI response we deliver. That responsibility remains constant no matter how quickly the technology moves.

All over the country, lawyers are using artificial intelligence to write briefs and help them prepare for court. It is not going well.

A family in Alabama lost a trust dispute last month because their lawyer filed citations to cases that do not exist. The Alabama Supreme Court dismissed their appeal, calling the conduct egregious, and barred the lawyer from filing in that court again without co-counsel sign-off.

In the same month, a federal judge in Oregon sanctioned two lawyers $110,000, the largest AI hallucination penalty in American legal history, after they submitted 23 fabricated citations and eight invented quotations. The case was subsequently dismissed.

In Manhattan, a judge ruled recently that a defendant who used a general-purpose AI chatbot to help prepare his case had waived attorney-client privilege. If you type your defense strategy into a chatbot, the government can subpoena it, read it, and use it against you.

According to a database compiled by lawyer and data scientist Damien Charlotin, there have now been more than 1,300 cases globally where a court or tribunal has commented on AI-generated hallucinations in legal filings. Behind each of those cases is a client who paid a lawyer and trusted the system. Behind each, more often than not, sits a lawyer who placed blind trust in a technology that generates text with complete confidence and no capacity for self-verification.

Not all AI is created equal. There is a real difference between general-purpose large language models like ChatGPT and Claude that have been trained on the open web, and industry-specific legal AI tools that are plugged into the same databases lawyers have been using for decades. Unfortunately, Wall Street has struggled to tell the difference.

When Anthropic released a legal plug-in for Claude recently, it contributed to a roughly $285 billion selloff in technology stocks. The chaos in courtrooms around the world tells a different story. Solving legal AI is harder than tweaking a standard large language model.

I have practiced law across three jurisdictions and now serve as General Counsel of one of the world’s largest legal technology companies, LexisNexis.

The question I am asked most often right now is, “Which AI is most capable?” My view is that this is the wrong question. The right one, “Which AI can be trusted in a courtroom?” is a different question. In law, those are not the same thing.

The obligation runs to the client and to the court simultaneously. The American Bar Association has identified how five of its Model Rules of Professional Conduct are directly impacted by AI use. They are competence, confidentiality, candor toward the tribunal, and supervisory responsibility.

When a lawyer submits a hallucinated citation, they fail their client. It is also a failure to the court. In fact, it corrupts the record the entire system depends on.

The structural problem runs deeper than which model a lawyer uses. General-purpose AI is designed to produce text that looks like the right answer, which in most domains is most of the job. In law it is the wrong job. The model cannot verify that the case it cited exists, that the case says what the brief claims, or that the case remains controlling authority. The gap is architectural, not a capability problem to be solved by the next training run. The consequences are concrete. Lawyers get sanctioned, claims get dismissed, defendants get handed to the prosecution.

The question to ask of any legal AI tool is not how it performs on a benchmark, but what it is built on, and whether a lawyer can trace, verify, and stand behind the output in open court.

There are two ways AI changes the practice of law. The first is compression, the same work, faster. The second is expansion, work that was never possible before. AI’s expansion potential in law is enormous, but it can only rest on a foundation that does not fabricate the underlying law. Litigation strategy built on decades of judge-specific outcome data is not a faster version of an existing task. It is work that did not previously exist. The same is true of regulatory monitoring built into deal documents that update the moment the law changes. There are many other examples, and the list grows weekly.

The market will eventually price what the profession has always known. In law, the cost of a wrong answer is paid in someone’s freedom, their assets, or their family’s future.

Small Law Firms Confident on Client Service but Face Growing Pressure to Improve Productivity and Profitability

New LexisNexis Bellwether research finds small and mid-sized firms are delivering strong client experiences, but capacity issues, margin pressure and inefficient workflows are limiting profitable growth.

LONDON, May 18, 2026 – LexisNexis® Legal & Professional, a global leader in private, secure, authoritative legal AI workflow solutions, announces today new research showing that small and mid-sized law firms remain confident in their ability to deliver excellent client service, but face growing pressure to become leaner, more focused and more profitable.

Findings from The Bellwether Report 2026: Lean, focused, profitable reveal a confident and client-focused legal market. More than four-fifths (84%) of respondents rated their client experience as good or excellent, while only 1% rated it as poor. Firms also pointed to diversity of skill to solve client problems (70%), having one point of contact for clients (69%) and maintaining a strong culture (67%) as key strengths.

The research suggests that client relationships remain central to small firm success. Only 13% of respondents said retaining current clients was a challenge, while 0% said client retention or repeat work was holding their firm back.

The survey also shows that growth is improving. Nearly two-thirds (62%) of firms said they had grown compared with three to four years ago, up from 58% last year. The proportion reporting a decline in revenue fell from 5% to 4%. Growth was broadly spread across practice areas, led by employment and commercial and corporate firms, both at 66%.

Profitability is concentrated in higher-value work. Litigation and dispute resolution, and private client-type work such as wills, probate, trusts and estate-related advice, were both cited as the most profitable types of work by 42% of respondents. However, the report found firms are struggling to protect that margin amid capacity constraints, talent pressures and inefficient delivery models.

Administrative tasks were cited as the biggest workflow issue by 52% of respondents, followed by case management (41%) and document drafting and review (28%). Low overheads also emerged as a weak point, with only 9% rating their firm as excellent in this area.

Talent is also becoming a more serious constraint. Difficulty attracting or retaining talent rose from 20% last year to 27%, while 25% of respondents cited capacity or resource constraints and 25% cited pressure on profit margins as blockers to growth.

In response, firms are planning more disciplined and technology-enabled growth. The top planned changes over the next 12 to 18 months are increasing the use of AI in research, drafting and review (41%) and standardising documents and workflows (40%). Two-thirds (67%) of firms plan to grow organically, while appetite for mergers and acquisitions has increased from 5% to 8%.

Commenting on the findings, Dylan Brown, Editor of The Bellwether Report 2026 at LexisNexis, said:

“Small law firms are going to great lengths to deliver a smooth, sophisticated client experience. The challenge is that too much of that service still depends on stretched teams, manual processes and inefficient workflows behind the scenes.

“The data shows that client service is not the problem. Firms are confident in the relationships they have built and the quality of advice they provide. The bigger issue is whether they can deliver that work consistently, profitably and without adding unnecessary strain.

“The firms best placed to grow will be those that protect what makes them valuable to clients, while becoming leaner, more focused and more disciplined in how work gets done.”

The legal AI market is moving quickly. New solutions can generate text, summarize documents and automate isolated tasks. But legal work requires something more demanding: current, authoritative legal content; verification tools; a connection to files; governance for confidentiality and privilege; and workflows that reflect how lawyers practice.

That distinction matters. Protégé Agentic Drafting helps lawyers and legal teams produce review-ready work product in minutes. Purpose-built drafting agents create contracts, motions, briefs and deal documents grounded in LexisNexis content, firm templates, prior work and matter materials. Drafts can reflect an organization’s preferred style, apply vetted exemplars, preserve formatting and surface risk considerations before work reaches a client, counterparty or court.

New agentic drafting capabilities in Protégé turn a single prompt into polished, review-ready work product grounded in LexisNexis content, firm templates, and matter materials - including in contract drafting.

Outputs from Protégé Skills can be delivered in the formats legal teams already use every day. This includes Microsoft Word for drafts, Excel for review tables and structured findings, PowerPoint for client-ready summaries, and PDF for polished, ready-to-use work product.

Protégé Workrooms extends legal AI into secure collaboration. Law firms, corporate legal departments and counsel can work together in private, permission-aware spaces where documents, drafts, analysis and AI workflows are shared only as authorized. Dual approvals, least-privilege access, role-based permissions and audit trails help teams collaborate across organizational lines while maintaining control of confidential information.

Shepard’s^® Verify Trust Markers bring LexisNexis’s trusted citation authority directly into AI-assisted work. The capability identifies legal citations in AI-generated and attorney-drafted content, checks them against LexisNexis authoritative legal sources, and flags citations that cannot be verified as existing. By confirming that cited authority exists and is retrievable at the point of use, Shepard’s Verify helps legal professionals protect their professional reputation and move from draft to final with greater confidence.

A reimagined Protégé Vault gives legal professionals a secure intelligence layer for large, complex matters. Teams can analyze documents, PDFs, spreadsheets, images, audio, video and other matter materials in one workspace, with support for up to 100,000 documents per Vault. Outputs link back to source material including exact document passages, spreadsheet rows, images or timestamps so legal teams can verify findings and defend the work product that follows.

Protégé BYOK gives enterprise and government customers additional control over sensitive information. With Bring Your Own Key encryption, customers can manage their own encryption keys through their chosen key management service and revoke access when required, supporting the data-control expectations of law firms, regulated industries and public-sector legal teams. With BYOK, LexisNexis integrates directly with a customer's own Key Management Service (KMS) — including AWS KMS, Azure Key Vault, Google Cloud KMS, and HashiCorp Vault — to encrypt all customer data at rest using keys that only the customer controls. After extensive testing, BYOK has been deployed in AmLaw 100 firms.
