How legal organizations are moving from productivity gains to authoritative, scalable advantage

NEW YORK, March 23, 2026 — At Legalweek 2026, I hosted an AI Workshop that brought together managing partners, general counsel, innovation leaders, and technologists for a candid discussion about where artificial intelligence is truly heading in legal.

Across the workshop’s three panels – examining the state of AI across the legal market, rethinking ROI for AI in the legal world, and leading and thriving in the AI-transformed legal workplace – one message was unmistakable: the conversation has matured.

Twelve months ago, the dominant questions centered on AI experimentation and adoption. Questions like: “Should we pilot generative AI?” “How do we drive lawyer usage?” “How do we increase comfort with emerging tools?” took center stage. The focus was on testing, learning, and accelerating productivity.

This year, the conversation was far more sophisticated. Legal leaders are no longer asking whether to adopt AI. They are asking how to generate measurable ROI, how to embed AI into core workflows, and how to translate productivity gains into sustainable competitive advantage.

Five themes stood out:

Efficiency Was the Entry Point, Not the Destination

Early AI adoption in legal was tactical. Success was measured in hours saved. But efficiency alone does not create advantage.

AI compresses certain forms of work, yet it also expands what is possible. Law firms are discovering that while clients expect AI-driven cost reductions, AI simultaneously enables broader analysis, faster strategic insight, and entirely new types of work that would have been impractical or impossible before. As one panelist noted, some of the biggest long-term opportunities may come from capabilities firms simply couldn’t offer clients previously.

The conversation is shifting from “How many hours did we save?” to “How is AI improving the quality, scope, and impact of the work we deliver?”

Authoritative AI Is Now the Baseline

In legal, credibility depends on trust. Large language models can generate fluent answers but without authoritative sources, structured taxonomy, citators, and validation layers, AI produces plausible text, not reliable legal work.

As adoption matures, legal organizations are prioritizing systems grounded in validated content and transparent sourcing. The differentiator is no longer access to generative capability alone. It is access to AI built on authoritative foundations.

Trust is not a feature. It is now the standard.

From Tools to Repeatable, Scalable Workflows

In 2025, many firms experimented with AI at the task level. In 2026, leaders are focused on repeatability.

Scalable advantage does not come from isolated use cases. It comes from embedding AI into standardized drafting frameworks, compliance reviews, and enterprise workflows.

Organizations are also revisiting foundational infrastructure decisions, including build-versus-buy strategies and how AI integrates across heterogeneous technology stacks. As AI evolves from experiments to agentic systems, governance and organizational design become even more critical.

Scale requires discipline, and repeatability turns experimentation into enterprise capability.

Judgment and Accountability Remain Scarce

AI makes analysis abundant, yet human judgment remains scarce.

Throughout our discussions, one theme resonated clearly: AI does not remove accountability – it concentrates it. Senior legal professionals remain responsible for risk calibration, ethical considerations, and final decisions.

As AI accelerates output, the human bottleneck becomes more visible. The opportunity is not to replace expertise, but to elevate it, freeing lawyers to focus on interpretation, strategy, and client counsel.

Competitive Advantage Will Be Defined by Execution and Operating Model Design

As AI becomes table stakes, competitive advantage will come not from access to tools, but from how organizations redesign the way legal work is structured, delivered, and staffed.

The leaders in this next phase will be those who:

Ground AI in trusted, authoritative content
Integrate it into repeatable, enterprise-scale workflows
Establish governance frameworks that address risk and accountability
Align talent models with AI-enabled practice
Measure ROI beyond hours saved, focusing now on higher-quality work, new services, and value creation

This shift is already reshaping the relationship between corporate legal departments and outside counsel. Corporate legal teams are under increasing pressure to reduce costs, and AI is enabling them to handle more work internally. In some cases, departments are performing portions of the analysis in-house and engaging their outside firms to validate conclusions or address the highest-risk aspects of a matter.

This raises important questions around responsibility, risk ownership, and how value is shared. The most successful firms are responding by working more closely with their clients to redesign workflows and create true win–win models that combine in-house efficiency with external expertise.

At the same time, the talent model for the profession is beginning to shift. As AI handles more foundational tasks, firms and legal departments must intentionally redesign training and evaluation to preserve professional judgment and long-term capability.

AI is not just a technology strategy. It is a talent strategy.

The Next Chapter

The legal industry appears to be moving through three stages:

Experimentation and adoption
Authority and integration
Scalable competitive advantage

For general counsel and managing partners, the mandate is clear. AI is no longer a pilot project. It is becoming foundational to how legal services are delivered, measured, and differentiated.

The future of AI in legal will not be defined by productivity alone. It will be defined by authority, scalability, and the ability to turn technological capability into sustained strategic advantage.

As genAI moved from experimentation to routine use, formal oversight remains inconsistent:

53% of professionals report using genAI without formal approval
28% say their organization has no formal genAI policy
55% personally pay for genAI tools, with 60% of those using them for work
19% received no AI training

These trends suggest AI is advancing inside organizations faster than enterprise controls are being established.

Confidence rises as organizations work to align oversight

The report highlights a growing gap between user confidence levels and organizational oversight maturity:

64% of professionals report being very or extremely confident in using genAI responsibly
74% of those who received mandatory AI training still report unauthorized genAI use
51% of organizations say they have launched internal AI agents
Only 44% of employees clearly understand what those AI agents are or how they function

As genAI systems become more autonomous, leadership focus will continue to shift from capabilities to accountability and whether appropriate guardrails are in place.

Human oversight remains essential

Despite growing autonomy in AI systems, professionals continue to emphasize the importance of human validation:

65% of professionals say human validation is very or extremely important
56% believe humans should remain involved at every stage
Only 9% support minimal human oversight

The data reinforces that AI effectiveness depends on structured validation, risk-tiered oversight, and clear policy frameworks.

A practical roadmap for leaders

To help organizations translate early momentum into sustainable value, the report outlines 10 immediate actions leaders can take to strengthen oversight and reduce risk, including:

Establishing cross-functional AI governance councils
Conducting enterprise-wide audits of AI usage

The Legal Plugin integration into Protégé has been tested over the last few weeks by a limited group of customers in commercial preview as part of the company's process to rapidly evaluate and incorporate new technologies and capabilities across multiple models and plugins that add value for legal customers and their daily work.

AI Is Speeding Up Junior Lawyers’ Work but Raising Questions About How Judgment Is Learned

New LexisNexis research finds that while AI is boosting productivity, firms must rethink how junior lawyers develop legal judgment, confidence, and critical reasoning.

LONDON, 02 February 2026 – LexisNexis® Legal & Professional, a global leader in private, secure, authoritative legal AI workflow solutions, announces today a new survey suggesting that while AI is transforming how legal work is done, it is also reshaping how junior lawyers learn, with significant implications for legal training, mentorship, and leadership.

Findings from The mentorship gap report show that more than half (58%) of lawyers using AI tools say they are producing legal work faster, rising to 65% among those using paid legal AI platforms. The research also shows that junior lawyers are increasingly using AI for tasks such as legal research, first drafts, and document review, activities that have traditionally played a central role in early legal training. Taken together, the findings raise questions about how legal judgment is developed as these tasks are completed more quickly or with greater AI assistance.

At the same time, the research identifies clear learning gaps. The biggest skills gap among junior lawyers is deep legal reasoning and argumentation, cited by 72% of respondents. Verification and source-checking skills are also a concern, flagged by 69%, pointing to ongoing challenges around how judgment and critical thinking are built.

When asked what would help junior lawyers build strong legal reasoning and judgment skills while using AI, nearly two-thirds (65%) of respondents selected positioning AI as a “thinking partner”, rather than a shortcut or replacement for legal expertise. An additional half (52%) said verification exercises that require juniors to check AI outputs against authoritative sources would help.

The research also highlights differences in how success is measured across the profession. Among law firm leaders, revenue growth is the most important performance metric (55%), followed by positive client feedback (49%) and billable hours (38%). Associates place greater emphasis on billable hours and client feedback (both 54%), with revenue growth close behind (48%). These differences suggest that performance measures may influence how AI is prioritised and used in practice.

As routine tasks change, firms need to be deliberate about how junior lawyers build the confidence and critical thinking that have traditionally come from experience.”

Lex Machina 2026 Trade Secret Litigation Report: Federal Trade Secret Filings Hit an All-Time High in 2025

Settlement remains most common resolution, but substantially lags rates in other civil litigation categories

San Jose, CA — January 29, 2026 — Lex Machina®, the LexisNexis® Legal Analytics® platform, today announced the release of its 2026 Trade Secret Litigation Report, delivering a comprehensive analysis of trade secret litigation in US federal courts since 2016. With this report, legal professionals have actionable, data-driven insights to better assess risk, strategy, and outcomes in trade secret litigation.

Key findings from the report include:

Record federal trade secret cases: Trade secret filings reached their highest level in the past decade. In 2025, filings reached over 1,500 cases, the highest total ever recorded. The Central District of California was the most active venue for trade secret litigation in 2025, with 100 newly filed lawsuits. This jump in filings signals a competitive landscape in which early decisions around case assessment and venue selection can potentially shape outcomes before a case gains momentum.

Not all DTSA: Although causes of action asserted under the federal Defend Trade Secrets Act (“DTSA”) continue to appear in more than 80 percent of new trade-secret lawsuits in federal courts each year, there are signs of renewed reliance on trade-secret claims asserted under state law. In each of the last two years, the frequency of state-law-only trade-secret claims increased in federal courts. This may be attributable in part to significant legal developments in 2023 and 2024. The revitalized use of state-law trade secret claims makes it important for practitioners to understand how evolving legal standards from multiple jurisdictions affect liability risk.

Lower settlement rates than other practice areas: Settlement remains the most common resolution for trade secret cases, with about 65 percent of district court cases resolving through likely settlement between 2023 and 2025. However, this rate is substantially lower than settlement rates observed in many other categories of federal civil litigation. Practitioners can incorporate analytical insights from Lex Machina to pressure-test pretrial strategies in trade secret cases that tend to have longer timelines and lower settlement rates.
