Lex Machina 2026 Patent Litigation Report: District Court Filings Reach a Ten-Year High as PTAB Activity Slows Sharply

San Jose, CA, August 5, 2026 — LexisNexis^®Legal & Professional announced today the release of the Lex Machina^® 2026 Patent Litigation Report, a comprehensive, data-driven analysis of trends shaping U.S. patent litigation in federal district and appellate courts and before the Patent Trial and Appeal Board (PTAB). Powered by insights from Lex Machina^®, the LexisNexis^® Legal Analytics^® platform, the report examines key developments from 2023 through 2025, places those findings in historical context dating back to 2016, and includes current observations from the first half of 2026. The analysis encompasses 38,893 patent cases filed in U.S. district courts and 3,589 federal circuit court cases docketed from 2016 through 2025, together with PTAB petitions and appeals.

Key findings from the report include:

District court patent filings reach a ten-year high before pulling back in 2026: Plaintiffs filed 4,547 patent cases in 2025, a 19.6 percent increase over 2024 and the highest total in the 2016–2025 period. From January 1 through June 30, 2026, claimants filed approximately 1,900 new patent lawsuits, putting 2026 on pace to finish comfortably below the record level reached in 2025.

Patent damages remain above $2 billion for a fourth consecutive year: Courts awarded $2.353 billion in patent damages across 63 cases in 2025, excluding fees and interest. From 2023 through 2025, reasonable royalty awards totaled $8.156 billion, with $8.066 billion awarded through verdicts, underscoring the continuing role of juries in the highest-value patent recoveries.

PTAB activity enters a sharp slowdown: Inter partes review petitions fell approximately 8 percent to 1,208 in 2025, while post-grant review petitions increased to 75, their highest level since 2021. In the first half of 2026, parties filed only 201 PTAB petitions—fewer than in any other half-year period in at least a decade.

From Chat to Work: Why Trust Is the Real Shift in Legal AI

Something shifted in legal AI over the past year. The shift is not about which model is most capable, or which platform has the most features. It is about what lawyers are actually asking AI to do.

From Answers to Outcomes

The way I describe first-generation legal AI is a sage sitting on a hill. You climb up, you ask a question, you get an answer, and you walk back down to do something with it yourself. The AI gave you knowledge. You still had to do the work.

Agentic AI brings the sage off the hill and into the workshop. When you ask them to do something, they act – they research, draft, verify citations, ask follow-up questions, and hand back something close to finished work product. You are not getting a response to carry back and act on. The work is getting done.

This matters because lawyers are not trying to produce AI outputs. They are trying to produce a brief, a contract review, a client memo. The gap between what AI returns and what a lawyer actually needs to deliver is what agentic workflows close. And that is a very different kind of value from what the first generation of legal AI was offering.

Trust Is Not a Feature – It Is the Prerequisite

Here is the challenge: agentic AI that closes the gap only matters if it does so reliably.

Moving from chat to work raises the stakes on accuracy in a specific way. When AI is answering questions, a lawyer can evaluate the response and decide what to do with it. When AI is producing work product, the verification layer has to be part of the workflow itself – not something added at the end.

Before a lawyer relies on any authority, two questions have to be answered: is this citation real, and is it still good law? Getting those answers used to mean a separate research step. With Shepard's® Verify, those signals appear in context, as part of the work. Upload a brief from opposing counsel, and Protégé checks every citation against our database: does it exist, is it still valid, how have subsequent courts treated it? The lawyer does not break flow to go verify. Verification comes to them.

That is the architecture that makes agentic legal AI usable in practice. Lawyers will adopt tools they can move quickly with – and they can move quickly when they can verify everything. Trust does not slow down the work. It is what makes the speed possible.

A Different Kind of Competitive Advantage

One of the most interesting things happening right now is how legal organizations are thinking about the model and platform question. A lot of firms have been experimenting with point solutions: a tool for research, a different one for drafting, another for review. What we are hearing increasingly is that clients want fewer tools, not more. They want something that can hold their way of working, not just a generic capability they have to configure from scratch every time.

The layer that matters in that context is not which foundational model is running. It is how well the platform understands legal work. A good platform should be able to draw on whichever model serves a particular use case best. What does not commoditize is legal content. Two hundred billion documents, four million added daily, 150-plus years of Shepard's intelligence. That is the fuel that makes the model actually useful for legal work.

Firms are also beginning to understand that they can bring their own way of working into the platform. Their playbook – the way their practice group approaches a particular matter type – can become a skill that the agent draws on. That is a meaningful shift from using a generic AI tool to using one that actually reflects how a firm works.

What This Means for the Work Ahead

I am genuinely optimistic about what agentic legal AI makes possible over the next few years. Some of this is work that simply did not exist before. For example, litigation strategy built on judge-specific outcome data and regulatory signals embedded in live deal documents. And some of it is about who gets access to legal expertise at all. Law is underserved in many parts of society, and AI that lawyers can trust and verify gives the profession capacity to serve more people in more places.

Also, junior lawyers are going to develop faster. For example, working through mock trials, mock depositions, richer training environments, getting to senior-level judgment more quickly than previous generations could. The floor of the profession rises.

But none of that happens unless lawyers trust the work being produced. The real shift in legal AI is not from one model to another, or from one feature set to the next. It is the move from answering questions to helping lawyers get work done. As AI moves from chat to work, trust becomes more than a requirement. It becomes the foundation that makes the entire transition possible. The measure of a legal AI platform is not what it can generate. It is what a lawyer can confidently put their name on.

Private law firms led for jury trial awards in federal courts: For jury-awarded damages, private law firms dominate the list of top earning law offices from 2023 to 2025, with ten law firms each directly responsible for achieving more than $1 billion in principal damages via plaintiffs’ jury verdicts in federal courts from 2023 to 2025.
Massive jury verdict awards in Los Angeles Superior Court: From 2023 through 2025, plaintiffs secured more than $2.4 billion in principal damages through jury verdicts in Los Angeles Superior Court alone, underscoring the scale of high-exposure civil litigation in one of the nation’s busiest trial courts.

At LexisNexis, we believe legal AI must do more than generate plausible answers. It must produce work lawyers can verify, defend, and trust.

We believe in ecosystem-based innovation, and we integrate external capabilities selectively – when they strengthen the legal work our customers need to perform.

That also means we test rigorously before we ship. We work closely with partners across the AI ecosystem to evaluate emerging capabilities against the standards legal work demands: citation accuracy, output consistency, grounding in authoritative sources, and clear attribution between what LexisNexis content supports and what a model generates independently.

MCP Testing: Our Criteria for Integration

When evaluating potential MCP connector integrations, we run methodical side-by-side comparisons across three configurations: the LLMs alone, LLMs with our MCP connector, and Lexis+ with Protégé.

In testing, if an LLM has access to our MCP connector – and introduces additional legal interpretations, adjacent statutes, or citations not provided by LexisNexis – our criteria for moving forward with an integration is not met. The same is true if the resulting output could reasonably lead a user to believe the full response was grounded in LexisNexis authority, when portions were generated independently by a model.

In addition to attribution ambiguity, consistency is another important consideration. Asking the same legal question multiple times through an LLM should not produce meaningfully different outputs. We require the same performance of Lexis+ with Protégé; each response to a given prompt should remain consistent and tightly tied to authoritative support.

For legal work, this difference matters. It can be the difference between work product a lawyer can confidently validate and output that requires additional scrutiny before use.

Why Authoritative Grounding Is Non-Negotiable

We are careful not to present authoritative LexisNexis content alongside model-generated material in ways that could blur attribution or undermine user confidence. This is not a competitive posture. It is a way of ensuring that we assist our customers in meeting their professional obligations.

Lawyers rely on LexisNexis because our legal AI is verifiable, citable, and connected to trusted legal authority. When a user cannot clearly distinguish between what LexisNexis has verified and what a model has generated independently, the trust that makes our legal AI useful is weakened – and the lawyer’s work product may carry risk the user cannot easily see.

AI without deep legal authority and built-in ability to verify can accelerate work. It can also accelerate the need for review. The pace of AI development is genuinely exciting, and we are deeply engaged with it. Our customers’ professional reputations depend on the verifiability, attribution, and integrity of every AI response we deliver. That responsibility remains constant no matter how quickly the technology moves.

All over the country, lawyers are using artificial intelligence to write briefs and help them prepare for court. It is not going well.

A family in Alabama lost a trust dispute last month because their lawyer filed citations to cases that do not exist. The Alabama Supreme Court dismissed their appeal, calling the conduct egregious, and barred the lawyer from filing in that court again without co-counsel sign-off.

In the same month, a federal judge in Oregon sanctioned two lawyers $110,000, the largest AI hallucination penalty in American legal history, after they submitted 23 fabricated citations and eight invented quotations. The case was subsequently dismissed.

In Manhattan, a judge ruled recently that a defendant who used a general-purpose AI chatbot to help prepare his case had waived attorney-client privilege. If you type your defense strategy into a chatbot, the government can subpoena it, read it, and use it against you.

According to a database compiled by lawyer and data scientist Damien Charlotin, there have now been more than 1,300 cases globally where a court or tribunal has commented on AI-generated hallucinations in legal filings. Behind each of those cases is a client who paid a lawyer and trusted the system. Behind each, more often than not, sits a lawyer who placed blind trust in a technology that generates text with complete confidence and no capacity for self-verification.

Not all AI is created equal. There is a real difference between general-purpose large language models like ChatGPT and Claude that have been trained on the open web, and industry-specific legal AI tools that are plugged into the same databases lawyers have been using for decades. Unfortunately, Wall Street has struggled to tell the difference.

When Anthropic released a legal plug-in for Claude recently, it contributed to a roughly $285 billion selloff in technology stocks. The chaos in courtrooms around the world tells a different story. Solving legal AI is harder than tweaking a standard large language model.

I have practiced law across three jurisdictions and now serve as General Counsel of one of the world’s largest legal technology companies, LexisNexis.

The question I am asked most often right now is, “Which AI is most capable?” My view is that this is the wrong question. The right one, “Which AI can be trusted in a courtroom?” is a different question. In law, those are not the same thing.

The obligation runs to the client and to the court simultaneously. The American Bar Association has identified how five of its Model Rules of Professional Conduct are directly impacted by AI use. They are competence, confidentiality, candor toward the tribunal, and supervisory responsibility.

When a lawyer submits a hallucinated citation, they fail their client. It is also a failure to the court. In fact, it corrupts the record the entire system depends on.

The structural problem runs deeper than which model a lawyer uses. General-purpose AI is designed to produce text that looks like the right answer, which in most domains is most of the job. In law it is the wrong job. The model cannot verify that the case it cited exists, that the case says what the brief claims, or that the case remains controlling authority. The gap is architectural, not a capability problem to be solved by the next training run. The consequences are concrete. Lawyers get sanctioned, claims get dismissed, defendants get handed to the prosecution.

The question to ask of any legal AI tool is not how it performs on a benchmark, but what it is built on, and whether a lawyer can trace, verify, and stand behind the output in open court.

There are two ways AI changes the practice of law. The first is compression, the same work, faster. The second is expansion, work that was never possible before. AI’s expansion potential in law is enormous, but it can only rest on a foundation that does not fabricate the underlying law. Litigation strategy built on decades of judge-specific outcome data is not a faster version of an existing task. It is work that did not previously exist. The same is true of regulatory monitoring built into deal documents that update the moment the law changes. There are many other examples, and the list grows weekly.

The market will eventually price what the profession has always known. In law, the cost of a wrong answer is paid in someone’s freedom, their assets, or their family’s future.

Small Law Firms Confident on Client Service but Face Growing Pressure to Improve Productivity and Profitability

New LexisNexis Bellwether research finds small and mid-sized firms are delivering strong client experiences, but capacity issues, margin pressure and inefficient workflows are limiting profitable growth.

LONDON, May 18, 2026 – LexisNexis® Legal & Professional, a global leader in private, secure, authoritative legal AI workflow solutions, announces today new research showing that small and mid-sized law firms remain confident in their ability to deliver excellent client service, but face growing pressure to become leaner, more focused and more profitable.

Findings from The Bellwether Report 2026: Lean, focused, profitable reveal a confident and client-focused legal market. More than four-fifths (84%) of respondents rated their client experience as good or excellent, while only 1% rated it as poor. Firms also pointed to diversity of skill to solve client problems (70%), having one point of contact for clients (69%) and maintaining a strong culture (67%) as key strengths.

The research suggests that client relationships remain central to small firm success. Only 13% of respondents said retaining current clients was a challenge, while 0% said client retention or repeat work was holding their firm back.

The survey also shows that growth is improving. Nearly two-thirds (62%) of firms said they had grown compared with three to four years ago, up from 58% last year. The proportion reporting a decline in revenue fell from 5% to 4%. Growth was broadly spread across practice areas, led by employment and commercial and corporate firms, both at 66%.

Profitability is concentrated in higher-value work. Litigation and dispute resolution, and private client-type work such as wills, probate, trusts and estate-related advice, were both cited as the most profitable types of work by 42% of respondents. However, the report found firms are struggling to protect that margin amid capacity constraints, talent pressures and inefficient delivery models.

Administrative tasks were cited as the biggest workflow issue by 52% of respondents, followed by case management (41%) and document drafting and review (28%). Low overheads also emerged as a weak point, with only 9% rating their firm as excellent in this area.

Talent is also becoming a more serious constraint. Difficulty attracting or retaining talent rose from 20% last year to 27%, while 25% of respondents cited capacity or resource constraints and 25% cited pressure on profit margins as blockers to growth.

In response, firms are planning more disciplined and technology-enabled growth. The top planned changes over the next 12 to 18 months are increasing the use of AI in research, drafting and review (41%) and standardising documents and workflows (40%). Two-thirds (67%) of firms plan to grow organically, while appetite for mergers and acquisitions has increased from 5% to 8%.

Commenting on the findings, Dylan Brown, Editor of The Bellwether Report 2026 at LexisNexis, said:

“Small law firms are going to great lengths to deliver a smooth, sophisticated client experience. The challenge is that too much of that service still depends on stretched teams, manual processes and inefficient workflows behind the scenes.

“The data shows that client service is not the problem. Firms are confident in the relationships they have built and the quality of advice they provide. The bigger issue is whether they can deliver that work consistently, profitably and without adding unnecessary strain.

“The firms best placed to grow will be those that protect what makes them valuable to clients, while becoming leaner, more focused and more disciplined in how work gets done.”

Raleigh, NC, April 22, 2026 — LexisNexis^® Legal & Professional, a global leader in information, analytics and AI-powered legal workflow solutions, today announced release of the LexisNexis CounselLink^® 2026 Trends Report: State of Outside Counsel Fees. The report indicates that law firm billing rates continued to rise in 2025, while the largest law firms further expanded their share of wallet. The findings highlight ongoing challenges for corporate legal departments seeking to manage outside counsel costs.

Average partner rates increased 5.1% in 2025, tying for the second-highest level recorded since CounselLink launched its annual Trends Report in 2013. The largest law firms maintained a significant pricing advantage, with median partner rates 40% higher than those of the next tier, down from 61% in the prior year, reflecting faster rate growth among mid-sized firms.

Law firms with 750+ lawyers continued to lead share of wallet, capturing more than half of total legal spend and a majority of new matters in 2025. This trend signals continued consolidation, particularly in high-value practice areas that command the highest billing rates.

“Legal departments continue to prioritize cost control, but underlying market forces are making that more difficult to achieve,” said Donna McCoy, Senior Director, Services at LexisNexis CounselLink. “Rate increases remain elevated, and more work is flowing to the largest firms. Together, these dynamics are reshaping how legal services are sourced and priced.”

The CounselLink Trends Report draws on the CounselLink Insight Benchmarking Database of more than $75 billion in legal spend across more than 580,000 timekeepers and nearly 2 million matters. The report analyzes eight key metrics, including law firm partner fees by firm size, hourly rates by practice area, firm size and location, and international rate comparisons. Importantly, the report is based on actual invoices paid in 2025 to outside counsel by corporate legal departments over a 12-month period.

Other key findings in the report include:

High-value practice areas continue to drive rate growth, with Mergers & Acquisitions partner rates increasing 8.8% and Data Privacy rising 8.4%
Data Privacy emerges as a premium practice, with median partner rates exceeding $1,000 per hour and more than two-thirds of work handled by the largest firms
Mid-sized firms significantly increased rates, resulting in firms of 501–750 lawyers having a median partner rate 19% higher than the prior year’s median, narrowing the pricing gap with the largest firms
Alternative fee arrangements remain limited, representing 8.3% of matters and 6.3% of total spend despite ongoing industry discussion
Staffing mix is increasingly impacting costs, with matter-level rates rising faster than partner rates in many practice areas, suggesting reduced focus on managing costs through timekeeper mix and resource allocation

“Legal departments have long used staffing strategies to manage costs, but this year’s data suggests those approaches may be becoming less effective,” added McCoy. “Organizations will need a more data-driven approach to benchmarking and managing outside counsel relationships.”

How legal organizations are moving from productivity gains to authoritative, scalable advantage

NEW YORK, March 23, 2026 — At Legalweek 2026, I hosted an AI Workshop that brought together managing partners, general counsel, innovation leaders, and technologists for a candid discussion about where artificial intelligence is truly heading in legal.

Across the workshop’s three panels – examining the state of AI across the legal market, rethinking ROI for AI in the legal world, and leading and thriving in the AI-transformed legal workplace – one message was unmistakable: the conversation has matured.

Twelve months ago, the dominant questions centered on AI experimentation and adoption. Questions like: “Should we pilot generative AI?” “How do we drive lawyer usage?” “How do we increase comfort with emerging tools?” took center stage. The focus was on testing, learning, and accelerating productivity.

This year, the conversation was far more sophisticated. Legal leaders are no longer asking whether to adopt AI. They are asking how to generate measurable ROI, how to embed AI into core workflows, and how to translate productivity gains into sustainable competitive advantage.

Five themes stood out:

Efficiency Was the Entry Point, Not the Destination

Early AI adoption in legal was tactical. Success was measured in hours saved. But efficiency alone does not create advantage.

AI compresses certain forms of work, yet it also expands what is possible. Law firms are discovering that while clients expect AI-driven cost reductions, AI simultaneously enables broader analysis, faster strategic insight, and entirely new types of work that would have been impractical or impossible before. As one panelist noted, some of the biggest long-term opportunities may come from capabilities firms simply couldn’t offer clients previously.

The conversation is shifting from “How many hours did we save?” to “How is AI improving the quality, scope, and impact of the work we deliver?”

Authoritative AI Is Now the Baseline

In legal, credibility depends on trust. Large language models can generate fluent answers but without authoritative sources, structured taxonomy, citators, and validation layers, AI produces plausible text, not reliable legal work.

As adoption matures, legal organizations are prioritizing systems grounded in validated content and transparent sourcing. The differentiator is no longer access to generative capability alone. It is access to AI built on authoritative foundations.

Trust is not a feature. It is now the standard.

From Tools to Repeatable, Scalable Workflows

In 2025, many firms experimented with AI at the task level. In 2026, leaders are focused on repeatability.

Scalable advantage does not come from isolated use cases. It comes from embedding AI into standardized drafting frameworks, compliance reviews, and enterprise workflows.

Organizations are also revisiting foundational infrastructure decisions, including build-versus-buy strategies and how AI integrates across heterogeneous technology stacks. As AI evolves from experiments to agentic systems, governance and organizational design become even more critical.

Scale requires discipline, and repeatability turns experimentation into enterprise capability.

Judgment and Accountability Remain Scarce

AI makes analysis abundant, yet human judgment remains scarce.

Throughout our discussions, one theme resonated clearly: AI does not remove accountability – it concentrates it. Senior legal professionals remain responsible for risk calibration, ethical considerations, and final decisions.

As AI accelerates output, the human bottleneck becomes more visible. The opportunity is not to replace expertise, but to elevate it, freeing lawyers to focus on interpretation, strategy, and client counsel.

Competitive Advantage Will Be Defined by Execution and Operating Model Design

As AI becomes table stakes, competitive advantage will come not from access to tools, but from how organizations redesign the way legal work is structured, delivered, and staffed.

The leaders in this next phase will be those who:

Ground AI in trusted, authoritative content
Integrate it into repeatable, enterprise-scale workflows
Establish governance frameworks that address risk and accountability
Align talent models with AI-enabled practice
Measure ROI beyond hours saved, focusing now on higher-quality work, new services, and value creation

This shift is already reshaping the relationship between corporate legal departments and outside counsel. Corporate legal teams are under increasing pressure to reduce costs, and AI is enabling them to handle more work internally. In some cases, departments are performing portions of the analysis in-house and engaging their outside firms to validate conclusions or address the highest-risk aspects of a matter.

This raises important questions around responsibility, risk ownership, and how value is shared. The most successful firms are responding by working more closely with their clients to redesign workflows and create true win–win models that combine in-house efficiency with external expertise.

At the same time, the talent model for the profession is beginning to shift. As AI handles more foundational tasks, firms and legal departments must intentionally redesign training and evaluation to preserve professional judgment and long-term capability.

AI is not just a technology strategy. It is a talent strategy.

The Next Chapter

The legal industry appears to be moving through three stages:

Experimentation and adoption
Authority and integration
Scalable competitive advantage

For general counsel and managing partners, the mandate is clear. AI is no longer a pilot project. It is becoming foundational to how legal services are delivered, measured, and differentiated.

The future of AI in legal will not be defined by productivity alone. It will be defined by authority, scalability, and the ability to turn technological capability into sustained strategic advantage.

These trends suggest AI is advancing inside organizations faster than enterprise controls are being established.

Confidence rises as organizations work to align oversight

The report highlights a growing gap between user confidence levels and organizational oversight maturity:

64% of professionals report being very or extremely confident in using genAI responsibly
74% of those who received mandatory AI training still report unauthorized genAI use
51% of organizations say they have launched internal AI agents
Only 44% of employees clearly understand what those AI agents are or how they function

As genAI systems become more autonomous, leadership focus will continue to shift from capabilities to accountability and whether appropriate guardrails are in place.

Despite growing autonomy in AI systems, professionals continue to emphasize the importance of human validation:

65% of professionals say human validation is very or extremely important
56% believe humans should remain involved at every stage
Only 9% support minimal human oversight

The data reinforces that AI effectiveness depends on structured validation, risk-tiered oversight, and clear policy frameworks.

US and China Dominate Academic Arena: The academic innovation leaders are mostly made up of US and Chinese institutions, highlighting their central role in high-impact research. Five-Year Innovation Momentum Shows Both Change and Continuity: Over five years, Top 100 recognitions have been awarded to 190 companies across 21 countries, led by the United States, followed by China and Germany.

Pharmaceuticals stood out with 87 recognitions, ahead of Semiconductors and Information Technologies. Biotechnologies showed the highest recurrence and stability, while Engineering reflected greater volatility with the lowest average repeat rate of companies.

The Legal Plugin integration into Protégé has been tested over the last few weeks by a limited group of customers in commercial preview as part of the company's process to rapidly evaluate and incorporate new technologies and capabilities across multiple models and plugins that add value for legal customers and their daily work.
