Abstract:

On 16 April 2025, the Australian Securities Exchange (ASX) issued Compliance Update No. 04/25, announcing the release of a Consultation Paper on proposed amendments to the ASX Settlement Operating Rules relating to Depositary Nominee services.

The proposed amendments seek to update the legal framework governing CHESS Depositary Interests (CDIs) by expanding the scope of CHESS Depositary Nominees Pty Limited (CDN) to act as a Depositary Nominee for issuers across all licensed markets. These changes would apply to both existing and new CDIs on issue. ASX is inviting written submissions on the proposed rule and procedural amendments by 16 May 2025.

The update also reminds listed entities of their obligations under Listing Rule 12.6 to maintain an up-to-date nominated contact person for ASX-related communication via ASX Online, and to notify their Listings Adviser of any changes, including temporary ones.
