The Federal Government recently passed the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022. This legislation amends the Fair Work Act to change several existing rules and introduces various new workplace laws. These include (but are not limited to):

  • Changing the objectives of the Fair Work Act to include promoting:
    • Job security
    • Gender equality
  • Prohibiting pay secrecy
  • New protected attributes under the Fair Work Act:
    • Breastfeeding
    • Gender identity
    • Intersex status
  • Sunsetting of ‘zombie agreements’
  • Changes to how bargaining agreements can be started through the Fair Work Commission
  • Updates to rules for agreements to allow the Fair Work Commission to terminate an agreement after its nominal expiry date.
